0011|     RELATING TO ELECTIONS; REQUIRING ADJUSTMENT OF PRECINCT
    |
0012|     BOUNDARY LINES IN PREPARATION FOR THE UPCOMING FEDERAL
    |
0013|     DECENNIAL CENSUS; AMENDING SECTIONS OF THE ELECTION CODE.

    |
0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 1-3-12 NMSA 1978 (being Laws 1984 (1st
    |
0017|     S.S.), Chapter 3, Section 4, as amended) is amended to read:
    |
0018|          "1-3-12.  ADJUSTING PRECINCT BOUNDARIES.--
    |
0019|               A. Before each federal decennial census, every
    |
0020|     precinct boundary shall be adjusted to coincide with a
    |
0021|     numbered or named street or road or with a visible terrain
    |
0022|     feature that is:
    |
0023|                    (1)  shown on the standard base maps developed
    |
0024|     pursuant to Subsection B of this section;
    |
0025|                    (2)  a designated census block boundary on
    |
0001|     the federal PL 94-171 2000 census block maps; or
    |
0002|                    (3)  approved by the secretary of state and the
    |
0003|     bureau of the census.
    |
0004|               B.  Prior to commencement of the federal decennial
    |
0005|     census, [(1)] the secretary of state shall have prepared and
    |
0006|     furnish to each county clerk standard base maps of the county. 
    |
0007|     The standard base map for nonurban areas of the county shall,
    |
0008|     as nearly as practical, show:
    |
0009|                    [(a)] (1)  all state and federal highways;
    |
0010|                    [(b)] (2)  all numbered and named county
    |
0011|     roads that have been certified to the state highway and
    |
0012|     transportation department;
    |
0013|                    [(c)] (3)  all military installation
    |
0014|     boundaries and federal and state prison boundaries;
    |
0015|                    [(d)] (4)  all major railroad lines; and
    |
0016|                    [(e)] (5)  other major terrain features
    |
0017|     such as flowing rivers and streams, arroyos, powerlines,
    |
0018|     pipelines and ridgelines and other acceptable census block
    |
0019|     boundaries [and].
    |
0020|               [(2)] C.  The board of county commissioners and
    |
0021|     the county clerks, upon receipt of the standard base maps from
    |
0022|     the secretary of state, shall:
    |
0023|                    [(a)] (1)  adjust all urban precinct
    |
0024|     boundaries to coincide with numbered or named street
    |
0025|     boundaries;
    |
0001|                    [(b)] (2)  adjust all nonurban precinct
    |
0002|     boundaries to coincide with suitable visible terrain features
    |
0003|     shown on the standard base map; provided that in order to make
    |
0004|     [such] an adjustment, two or more existing precincts may be
    |
0005|     consolidated without consolidating existing polling places; and
    |
0006|     provided further that [such] the precincts shall be
    |
0007|     composed of contiguous and compact areas, and state, county and
    |
0008|     municipal boundary lines may serve as precinct boundaries; and
    |
0009|                    [(c)] (3)  upon the completion of the
    |
0010|     precinct boundary adjustments as required in this section,
    |
0011|     indicate on the standard base maps the boundaries for both
    |
0012|     urban and nonurban precincts and, together with a written
    |
0013|     description of the precincts, shall send four copies of the
    |
0014|     precinct maps to the secretary of state for approval.
    |
0015|               [C.] D.  The precincts shown upon the standard
    |
0016|     base maps submitted pursuant to the provisions of [Subsection
    |
    B of] this section and as revised and approved by the
    |
0018|     secretary of state pursuant to the Precinct Boundary Adjustment
    |
0019|     Act shall become the official precincts of each county for the
    |
0020|     2001 redistricting of legislative, congressional and state
    |
0021|     board of education districts.  For the 2002 and subsequent
    |
0022|     primary and general elections, changes in precincts shall be
    |
0023|     made in accordance with the provisions of Chapter 1, Article 3
    |
0024|     NMSA 1978."
    |
0025|          Section 2.  Section 1-3-13 NMSA 1978 (being Laws 1983,
    |
0001|     Chapter 223, Section 4, as amended) is amended to read:
    |
0002|          "1-3-13.  SECRETARY OF STATE POWERS AND DUTIES.--
    |
0003|               A.  The secretary of state shall review all county
    |
0004|     precinct maps submitted pursuant to Section 1-3-12 NMSA 1978
    |
0005|     for compliance with the provisions of the Precinct Boundary
    |
0006|     Adjustment Act.  Those county precinct maps determined not to
    |
0007|     be in compliance with the precinct boundary criteria set forth
    |
0008|     in Subsection A of Section 1-13-12 NMSA 1978 shall be rejected
    |
0009|     and returned to the appropriate county clerk with a written
    |
0010|     statement [of noncompliance] setting forth those instances
    |
0011|     where the map [is in default] does not comply.  The county
    |
0012|     clerk and the board of county commissioners shall make the
    |
0013|     required adjustments and resubmit one copy of the corrected
    |
0014|     county precinct map within thirty days after receiving notice
    |
0015|     of noncompliance.
    |
0016|               B.  Prior to January 1, [1992] 2002, if any
    |
0017|     precinct boundary adjustments are necessary to meet the legal
    |
0018|     and constitutional requirements of legislative reapportionment,
    |
0019|     the secretary of state shall notify any county of those
    |
0020|     boundary adjustments that are necessary in that county.  Upon
    |
0021|     review and certification of the adjusted precinct boundaries,
    |
0022|     the county shall submit the certified precinct changes to the
    |
0023|     secretary of state for final approval of the precincts for the
    |
0024|     [1992] 2002 primary and general elections."
