Section 67-3-40 NMSA 1978 (being Laws 1919, | 0018| Chapter 99, Section 13) is amended to read: | 0019| "67-3-40. CONTROL OF STATE HIGHWAYS--MAINTENANCE.-- | 0020| A. The state highway commission shall have full | 0021| control over all roads designated by the ~~[said]~~ commission as | 0022| state highways or created as state highways by acts of the | 0023| legislature ~~[and]~~. The costs of maintenance thereof shall be | 0024| paid by the state, provided, that if at any time the ~~[moneys]~~ | 0025| money in the state road fund available for improvement or | 0001| maintenance of all such state highways in the state shall not | 0002| be sufficient for such purposes, the state highway commission | 0003| shall certify to the respective boards of county commissioners | 0004| the certain sections of such highways in the ~~[several]~~ | 0005| counties, proportionately to such deficiency, which shall be | 0006| improved and maintained wholly by the respective counties until | 0007| sufficient funds ~~[shall be]~~ are provided in the state road | 0008| fund to enable the state to take over and maintain them as | 0009| state highways, subject to payment as provided in Subsection B | 0010| of this section. | 0011| B. Upon determination by the state highway | 0012| commission to certify turnover of some sections of state | 0013| highways to the boards of county commissioners for county | 0014| maintenance pursuant to Subsection A of this section, the | 0015| commission shall calculate a per-mile amount pursuant to this | 0016| subsection and shall pay each county an amount equal to the | 0017| per-mile amount multiplied by the miles of state highway turned | 0018| over to the county.
