0014|     PROVIDING SANCTIONS; AMENDING A SECTION OF THE ALCOHOL SERVER

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|          Section 1.  Section 60-6D-4 NMSA 1978 (being Laws 1993,
    |
0019|     Chapter 68, Section 31, as amended) is amended to read:

0020|          "60-6D-4.  ALCOHOL SERVER TRAINING--<s>[REQUIRED FOR LICENSE

<s></s>0021| <s>    RENEWAL]</s><u>REQUIREMENT TO COMPLETE A PROGRAM--SANCTIONS FOR
</u>    |
<u></u>0022| <u>    NONCOMPLIANCE</u>.--<s>[Beginning July 1, 1995, a licensee seeking
</s>    |
<s></s>0023| <s>    renewal of a license shall submit to the department, as a
</s>    |
<s></s>0024| <s>    condition of license renewal, proof that the licensee, his
</s>    |
<s></s>0025| <s>    lessee and each server employed by the licensee or lessee
</s>    |
<s></s>0001| <s>    during the prior licensing year have completed alcohol server
</s>    |
<s></s>0002| <s>    programs certified by the alcohol server education advisory
</s>    |
<s></s>0003| <s>    committee pursuant to provisions of the Liquor Control Act.]</s>
    |
0004|     <u>         A.  A licensee, his lessee or a server employed by
</u>    |
<u></u>0005| <u>    the licensee or lessee shall have successfully completed a
</u>    |
<u></u>0006| <u>    program certified by the alcohol server education advisory
</u>    |
<u></u>0007| <u>    committee.
</u>    |
<u></u>0008| <u>              B.  A server shall provide a copy of the certificate
</u>    |
<u></u>0009| <u>    attesting to his successful completion of a program to the
</u>    |
<u></u>0010| <u>    licensee or lessee who employs him.
</u>    |
<u></u>0011| <u>              C.  During hours of employment on licensed premises,
</u>    |
<u></u>0012| <u>    a licensee, his lessee or a server employed by the licensee or
</u>    |
<u></u>0013| <u>    lessee shall be required to keep a certificate attesting to
</u>    |
<u></u>0014| <u>    successful completion of a program on his person.  If
</u>    |
<u></u>0015| <u>    requested, he shall present the certificate to an inspector
</u>    |
<u></u>0016| <u>    from the alcohol and gaming division of the regulation and
</u>    |
<u></u>0017| <u>    licensing department or a special agent from the department of
</u>    |
<u></u>0018| <u>    public safety conducting an inspection of the licensed
</u>    |
<u></u>0019| <u>    premises.
</u>    |
<u></u>0020| <u>              D.  A licensee or lessee may lawfully terminate the
</u>    |
<u></u>0021| <u>    employment of an individual he employs as a server who fails to
</u>    |
<u></u>0022| <u>    comply with the provisions of Subsection A, B or C of this
</u>    |
<u></u>0023| <u>    section.
</u>    |
<u></u>0024| <u>              E.  When a licensee or his lessee fails to comply
</u>    |
<u></u>0025| <u>    with the provisions of Subsection A or C of this section, it is
</u>    |
<u></u>0001| <u>    a violation of the Liquor Control Act.</u>"

0002|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0003|     provisions of this act is July 1, 1997.
