GARCIA | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO DOMESTIC VIOLENCE; ESTABLISHING THE DOMESTIC | 0012| VIOLENCE OVERSIGHT TASK FORCE; MAKING AN APPROPRIATION. | 0013| | 0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0015| Section 1. DOMESTIC VIOLENCE OVERSIGHT TASK FORCE | 0016| CREATED--TERMINATION.--The "domestic violence oversight task | 0017| force" is created. The task force shall function from the date | 0018| of its appointment until the first day of December prior to the | 0019| second session of the forty-fourth legislature. | 0020| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.-- | 0021| A. The domestic violence oversight task force shall | 0022| be composed of ten legislative members, six public members and | 0023| nine advisory members from the executive and judicial branches | 0024| of government. | 0025| B. Five members of the house of representatives | 0001| shall be appointed by the speaker of the house of | 0002| representatives and five members of the senate shall be | 0003| appointed by the committees' committee of the senate, or, if | 0004| the senate appointments are made in the interim, by the | 0005| president pro tempore of the senate after consultation and with | 0006| the agreement of a majority of the members of the committees' | 0007| committee. Members shall be appointed from each house so as to | 0008| give the two major political parties in each house the same | 0009| proportional representation on the task force as prevails in | 0010| each house; however, in no event shall either party have less | 0011| than one member from each house on the task force. Vacancies | 0012| on the task force shall be filled by appointment in the same | 0013| manner as the original appointments. | 0014| C. Three public members shall be appointed to the | 0015| task force by the speaker of the house of representatives, and | 0016| three public members shall be appointed by the president pro | 0017| tempore of the senate so as to represent the state's ethnic and | 0018| geographic diversity. The public members of the task force | 0019| shall be paid per diem and mileage in accordance with the | 0020| provisions of the Per Diem and Mileage Act plus reimbursement | 0021| for reasonable actual expenses. | 0022| D. Additionally the task force shall include the | 0023| following advisory members: | 0024| (1) the attorney general or his designee; | 0025| (2) the secretary of health or his designee; | 0001| (3) the chief justice of the supreme court or | 0002| his designee; | 0003| (4) the president of the district judges | 0004| association or his designee; | 0005| (5) the president of the magistrate judges | 0006| association or his designee; | 0007| (6) the president of the municipal judges | 0008| association or his designee; | 0009| (7) the chief judge of the Bernalillo county | 0010| metropolitan court or his designee; | 0011| (8) the chief public defender; and | 0012| (9) one district attorney appointed by the | 0013| president of the district attorneys' association. | 0014| E. The speaker of the house of representatives and | 0015| the president pro tempore of the senate shall each designate | 0016| one co-chairman of the task force. | 0017| Section 3. DUTIES.-- | 0018| A. After its appointment, the domestic violence | 0019| oversight task force shall hold one organizational meeting to | 0020| develop a work plan and budget for the ensuing interim. The | 0021| work plan and budget shall be submitted to the legislative | 0022| council for approval. | 0023| B. Upon approval of the work plan and budget by the | 0024| legislative council, the task force shall review the adequacy | 0025| of the following programs and services as they relate to | 0001| domestic violence, including: | 0002| (1) law enforcement needs and training; | 0003| (2) judicial needs and training; | 0004| (3) state- and community-based domestic | 0005| violence prevention programs and services; and | 0006| (4) alcohol and drug abuse education, | 0007| prevention, screening and treatment. | 0008| C. The task force shall recommend legislation or | 0009| budget changes if any are found to be necessary to the | 0010| legislature. | 0011| Section 4. REPORT.--The domestic violence oversight task | 0012| force shall make a report of its findings and recommendations | 0013| for the consideration of the second session of the forty-third | 0014| legislature, the first session of the forty-fourth legislature | 0015| and the second session of the forty-fourth legislature. The | 0016| reports and suggested legislation shall be made available to | 0017| the legislative council on or before December 15 preceding each | 0018| session. | 0019| Section 5. STAFF.--The staff for the domestic violence | 0020| oversight task force shall be provided by the legislative | 0021| council service. | 0022| Section 6. APPROPRIATION.--Forty-nine thousand five | 0023| hundred dollars ($49,500) is appropriated from the general fund | 0024| to the legislative council service for expenditure in fiscal | 0025| year 1998 for the purpose of paying the salaries and expenses | 0001| of technical, legal and clerical staff; for purchasing | 0002| equipment and supplies; and for reimbursing the per diem and | 0003| mileage expenses of the domestic violence oversight task force | 0004| members. Any unexpended or unencumbered balance remaining at | 0005| the end of fiscal year 1998 shall revert to the general fund. | 0006| Section 7. EFFECTIVE DATE.--The effective date of the | 0007| provisions of this act is July 1, 1997. | 0008|  |
