0001| SENATE BILL 32 | 0002| 43rd legislature - STATE OF NEW MEXICO - first session, 1997 | 0003| INTRODUCED BY | 0004| GLORIA HOWES | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO MUNICIPALITIES; PROVIDING MUNICIPALITIES WITH | 0012| AUTHORITY TO ADOPT CURFEW ORDINANCES; VESTING CERTAIN COURTS | 0013| WITH EXCLUSIVE JURISDICTION OVER CURFEW VIOLATIONS; PRESCRIBING | 0014| PENALTIES; AMENDING SECTIONS OF THE NMSA 1978. | 0015| | 0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0017| Section 1. Section 3-17-1 NMSA 1978 (being Laws 1965, | 0018| Chapter 300, Section 14-16-1, as amended) is amended to read: | 0019| "3-17-1. ORDINANCES--PURPOSES.--The governing body of a | 0020| municipality may adopt ordinances or resolutions not | 0021| inconsistent with the laws of New Mexico for the purpose of: | 0022| A. effecting or discharging the powers and duties | 0023| conferred by law upon the municipality; | 0024| B. providing for the safety, preserving the health, | 0025| promoting the prosperity and improving the morals, order, | 0001| comfort and convenience of the municipality and its | 0002| inhabitants; and | 0003| C. enforcing obedience to the ordinances by | 0004| prosecution in the municipal court and metropolitan courts and | 0005| upon conviction the imposition of: | 0006| (1) except for those violations of ordinances | 0007| described in Paragraphs (2), [and] (3) and (4) of this | 0008| subsection, a fine of not more than five hundred dollars ($500) | 0009| or imprisonment for not more than ninety days or both; | 0010| (2) for a violation of an ordinance | 0011| prohibiting driving a motor vehicle while under the influence | 0012| of intoxicating liquor or drugs, a fine of not more than one | 0013| thousand dollars ($1,000) or imprisonment for not more than | 0014| three hundred sixty-four days or both; [and] | 0015| (3) for violations of an industrial user | 0016| wastewater pretreatment ordinance as required by the United | 0017| States environmental protection agency, a fine of not more | 0018| than one thousand dollars ($1,000) a day for each violation; | 0019| and | 0020| (4) for a violation of a curfew ordinance, a | 0021| fine of not more than five hundred dollars ($500) or community | 0022| service, or both." | 0023| Section 2. Section 32A-2-29 NMSA 1978 (being Laws 1993, | 0024| Chapter 77, Section 58) is amended to read: | 0025| "32A-2-29. MOTOR VEHICLE CODE VIOLATIONS--CURFEW | 0001| VIOLATIONS.-- | 0002| A. The municipal, magistrate or metropolitan court | 0003| shall have original exclusive jurisdiction over all Motor | 0004| Vehicle Code violations, [or] municipal traffic code | 0005| violations or municipal curfew violations when the person | 0006| alleged to have committed the violation is a child, with the | 0007| exception of those violations contained in Paragraph (1) of | 0008| Subsection A of Section [32-2-3] 32A-2-3 NMSA 1978 and all | 0009| traffic offenses alleged to have been committed by the child | 0010| arising out of the same occurrence pursuant to Subsection B of | 0011| this section. | 0012| B. If the children's court acquires jurisdiction | 0013| over a child pursuant to any of those Motor Vehicle Code | 0014| violations contained in Paragraph (1) of Subsection A of | 0015| Section [32-2-3] 32A-2-3 NMSA 1978, it shall have | 0016| jurisdiction over all traffic offenses alleged to have been | 0017| committed by the child arising out of the same occurrence. | 0018| C. All traffic offenses [which] that the child | 0019| is found to have committed by the municipal, magistrate or | 0020| metropolitan court or for which the child is adjudicated | 0021| delinquent by the children's court shall be subject to the | 0022| reporting requirements and the suspension and revocation | 0023| provisions of the Motor Vehicle Code and shall not be subject | 0024| to the confidentiality provisions of the Delinquency Act. | 0025| D. No tribunal may incarcerate any child who has | 0001| been found guilty of any Motor Vehicle Code violations, | 0002| [or] municipal traffic code violations or municipal curfew | 0003| violations without first securing the approval of the | 0004| children's court." | 0005| Section 3.
