0011| RELATING TO PROBATE; PROVIDING THAT A DECEDENT'S SURVIVING
|
0012| SPOUSE IS ENTITLED TO A PERSONAL PROPERTY ALLOWANCE; AMENDING A
|
0013| SECTION OF THE UNIFORM PROBATE CODE; DECLARING AN EMERGENCY.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 45-2-403 NMSA 1978 (being Laws 1993,
|
0017| Chapter 174, Section 21, as amended) is amended to read:
|
0018| "45-2-403. PERSONAL PROPERTY ALLOWANCE.--In addition to
|
0019| the family allowance, the decedent's surviving spouse [who is
|
a devisee under the will] is entitled from the estate to a
|
0021| value, not exceeding ten thousand dollars ($10,000) in excess
|
0022| of any security interests therein, in household furniture,
|
0023| automobiles, furnishings, appliances and personal effects. If
|
0024| there is no surviving spouse, the decedent's children who are
|
0025| devisees under the will or, if there is no will, who are
|
0001| intestate heirs are entitled jointly to the same value. If
|
0002| encumbered chattels are selected and the value in excess of
|
0003| security interests plus that of other exempt property is less
|
0004| than ten thousand dollars ($10,000) or if there is not ten
|
0005| thousand dollars ($10,000) worth of exempt property in the
|
0006| estate, the spouse or children are entitled to other assets of
|
0007| the estate, if any, to the extent necessary to make up the ten
|
0008| thousand dollar ($10,000) value. Rights to specific property
|
0009| for the family allowance and assets needed to make up a
|
0010| deficiency in the property have priority over all claims
|
0011| against the estate, but the right to any assets to make up a
|
0012| deficiency of exempt property abates as necessary to permit
|
0013| earlier payment of the family allowance. These rights are in
|
0014| addition to any benefit or share passing to the surviving
|
0015| spouse or children by intestate succession or by the decedent's
|
0016| will, unless otherwise provided by the decedent in the will or
|
0017| other governing instrument."
|
0018| Section 2. EMERGENCY.--It is necessary for the public
|
0019| peace, health and safety that this act take effect immediately.
