SANCHEZ | 0005| | 0006| | 0007| | 0008| FOR THE LEGISLATIVE HEALTH AND HUMAN SERVICES COMMITTEE | 0009| | 0010| AN ACT | 0011| RELATING TO HEALTH; ESTABLISHING MINIMUM STAFFING RATIOS IN | 0012| NURSING FACILITIES; CREATING DEFINITIONS. | 0013| | 0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0015| Section l. NURSING FACILITIES--MINIMUM STAFFING RATIOS.-- | 0016| A. Nursing facilities licensed pursuant to the | 0017| provisions of Section 24-1-5 NMSA 1978 shall employ personnel | 0018| sufficient to meet the care needs of each patient and shall | 0019| provide minimum direct caregiver-to-resident ratios as follows: | 0020| (1) one direct caregiver per five residents | 0021| during the day; | 0022| (2) one direct caregiver per ten residents | 0023| during the evening; and | 0024| (3) one direct caregiver per fifteen residents | 0025| at night. | 0001| B. Nursing facilities licensed pursuant to the | 0002| provisions of Section 24-1-5 NMSA 1978 shall employ personnel | 0003| sufficient to meet the care needs of each patient and shall | 0004| provide minimum nursing staff-to-resident ratios as follows: | 0005| (1) one licensed nurse per fifteen residents | 0006| during the day; | 0007| (2) one licensed nurse per twenty-five | 0008| residents during the evening; and | 0009| (3) one licensed nurse per thirty-five | 0010| residents at night. | 0011| C. For purposes of this section: | 0012| (1) "direct caregiver" means a certified | 0013| nursing assistant or certified nursing aide, licensed by the | 0014| department of health, but does not include either of these | 0015| persons when working as a trainee or when assigned to laundry | 0016| or other support responsibilities; and | 0017| (2) "licensed nurse" means a person licensed | 0018| by the board of nursing and employed as a registered nurse, | 0019| licensed practical nurse, certified nurse practitioner, | 0020| clinical nurse specialist or certified registered nurse | 0021| anesthetist when working as a nurse or nursing supervisor, but | 0022| not when employed in an administrative capacity. | 0023| D.
