0011| RELATING TO CRIMES; DEFINING UNLAWFUL CARRYING OF A DEADLY

0012| WEAPON ON STATE PREMISES; PROVIDING A PENALTY.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. A new Section 30-7-2.4 NMSA 1978 is enacted to
|
0016| read:
|
0017| "30-7-2.4. [NEW MATERIAL] UNLAWFUL CARRYING OF A
|
0018| DEADLY WEAPON ON STATE PREMISES.--
|
0019| A. Unlawful carrying of a deadly weapon on state
|
0020| premises consists of carrying a deadly weapon on state premises
|
0021| by a person other than:
|
0022| (1) a peace officer in the lawful discharge of
|
0023| his duties;
|
0024| (2) private security personnel hired by or
|
0025| under contract with the state to provide armed security; or
|
0001| (3) a person older than nineteen years of age
|
0002| in a private automobile or other private means of conveyance
|
0003| for lawful protection of the person's or another's person or
|
0004| property.
|
0005| B. As used in this section:
|
0006| (1) "state" means the state of New Mexico and
|
0007| any of its branches, agencies, departments, boards,
|
0008| commissions, instrumentalities and institutions, including
|
0009| higher education institutions; and
|
0010| (2) "state premises" means the buildings,
|
0011| together with grounds and parking areas, in or on which state
|
0012| activities are regularly conducted under the supervision of
|
0013| state management personnel.
|
0014| C. Whoever commits unlawful carrying of a deadly
|
0015| weapon on state premises is guilty of a fourth degree felony."
