0011| RELATING TO COUNTIES; PROVIDING THAT CERTAIN COUNTY ORDINANCES

0012| TAKE EFFECT IMMEDIATELY AFTER PASSAGE; AMENDING A SECTION OF

0013| THE NMSA 1978.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 4-37-9 NMSA 1978 (being Laws 1975,
|
0017| Chapter 312, Section 9) is amended to read:
|
0018| "4-37-9. COUNTY ORDINANCES--RECORDING AND PUBLICATION--
|
0019| EFFECTIVE DATE.--
|
0020| A. All county ordinances, immediately after their
|
0021| passage, shall be recorded in a book kept for that purpose and
|
0022| shall be authenticated by the signature of the county clerk.
|
0023| B. No ordinance shall take effect until thirty days
|
0024| after the ordinance has been recorded in the book kept by the
|
0025| county for that purpose.
|
0001| C. Notwithstanding the provisions of Subsection B
|
0002| of this section, when a board of county commissioners declares
|
0003| that it is necessary for the public peace, health and safety
|
0004| that an ordinance take effect immediately after passage, the
|
0005| ordinance shall take effect when it is recorded in the book
|
0006| kept by the county for that purpose and authenticated by the
|
0007| signature of the county clerk."
|
0008| Section 2. EFFECTIVE DATE.--The effective date of the
|
0009| provisions of this act is July 1, 1997.
