SANCHEZ | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO EDUCATION; PROVIDING FOR THE ESTABLISHMENT OF A | 0012| SCHOOL OF VETERINARY MEDICINE AT NEW MEXICO STATE UNIVERSITY IN | 0013| LAS CRUCES IN DONA ANA COUNTY; MAKING AN APPROPRIATION. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 21-8-1 NMSA 1978 (being Laws 1889, | 0017| Chapter 138, Section 19, as amended) is amended to read: | 0018| "21-8-1. PURPOSE AND CHARACTER OF NEW MEXICO STATE | 0019| UNIVERSITY. [SEC. 112. The] New Mexico [College of | 0020| Agriculture and Mechanic Arts] state university shall be an | 0021| institution of learning open to the children of all the | 0022| residents of this state and to such other persons as the | 0023| board of regents may determine, under such terms, rules and | 0024| regulations as may be prescribed by [said] the board of | 0025| regents. The university shall be nonsectarian in character | 0001| and devoted to practical instruction in agriculture and | 0002| veterinary science, mechanic arts and natural sciences | 0003| connected therewith, as well as a thorough course of | 0004| instruction in all branches of learning bearing upon | 0005| agriculture and other industrial pursuits." | 0006| Section 2. Section 21-8-3 NMSA 1978 (being Laws 1889, | 0007| Chapter 138, Section 20, as amended) is amended to read: | 0008| "21-8-3. CURRICULUM--BOARD OF REGENTS--NUMBER-- | 0009| QUALIFICATIONS--QUORUM.--The course of instruction of [the | 0010| college hereby created] New Mexico state university shall | 0011| embrace the English language, literature, mathematics, | 0012| philosophy, civil engineering, chemistry, [and] animal and | 0013| vegetable anatomy and physiology, veterinary medicine and the | 0014| veterinary art, entomology, geology, [and] political, rural | 0015| and household economy, horticulture, moral philosophy, history, | 0016| mechanics and such other sciences and courses of instruction as | 0017| shall be prescribed by the board of regents of [this | 0018| institution of learning] New Mexico state university. The | 0019| management of [said college] the university and experiment | 0020| station, the care and preservation of all property of which | 0021| [such institution] the university shall become possessed, | 0022| the erection and construction of all buildings necessary for | 0023| the use of [said college] the university and station and | 0024| the disbursement and expenditure of all [moneys] money | 0025| provided for by [this act] law shall be vested in a board | 0001| of five regents. [Said] The five regents shall possess the | 0002| same qualifications [as] required for the regents of the | 0003| university of New Mexico. [Said] The regents [and their | 0004| successors in office] shall constitute a body corporate with | 0005| the name and style of the [The] regents of [the] New Mexico | 0006| [College of agriculture and mechanic arts] state | 0007| university, with the right as such of suing and being sued, | 0008| [of] contracting and being contracted with, [of] making and | 0009| using a common seal and altering the same at pleasure [of] | 0010| and causing all things to be done necessary to carry out the | 0011| provisions of law. A majority of the board shall constitute a | 0012| quorum for the transaction of business, but a [less] lesser | 0013| number may adjourn from time to time." | 0014| Section 3. APPROPRIATION.--Three hundred million dollars | 0015| ($300,000,000) is appropriated from the general fund to the | 0016| board of regents of New Mexico state university for expenditure | 0017| in fiscal year 1998 for the purpose of establishing, making | 0018| capital expenditures for and operating a school of veterinary | 0019| medicine at the main campus of New Mexico state university in | 0020| Las Cruces. Any unexpended or unencumbered balance remaining | 0021| at the end of fiscal year 1998 shall revert to the general | 0022| fund. | 0023| Section 4. EFFECTIVE DATE.--The effective date of the | 0024| provisions of this act is July 1, 1997. | 0025|  |
