0011| RELATING TO COURTS; PROVIDING FOR ADDITIONAL DISTRICT AND

0012| METROPOLITAN COURT JUDGES; PROVIDING FOR SUPPLEMENTAL AND

0013| EXPANSION FUNDING FOR COURTS, JUDICIAL AGENCIES AND JUDICIAL
|
0014| PURPOSES; MAKING APPROPRIATIONS.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 34-6-4 NMSA 1978 (being Laws 1968,
|
0018| Chapter 69, Section 7, as amended) is amended to read:
|
0019| "34-6-4. JUDGES--FIRST JUDICIAL DISTRICT.--There shall be
|
0020| [six] seven district judges in the first judicial
|
0021| district."
|
0022| Section 2. Section 34-6-5 NMSA 1978 (being Laws 1968,
|
0023| Chapter 69, Section 8, as amended) is amended to read:
|
0024| "34-6-5. JUDGES--SECOND JUDICIAL DISTRICT.--There shall
|
0025| be [twenty-one] twenty-three district judges in the second
|
0001| judicial district."
|
0002| Section 3. Section 34-8A-8 NMSA 1978 (being Laws 1979,
|
0003| Chapter 346, Section 8, as amended) is amended to read:
|
0004| "34-8A-8. METROPOLITAN COURT--BERNALILLO DISTRICT.--
|
0005| A. The name of the metropolitan court in the
|
0006| Bernalillo metropolitan district shall be the "Bernalillo
|
0007| county metropolitan court".
|
0008| B. The metropolitan court is an agency of the
|
0009| judicial department of state government. Personnel of the
|
0010| metropolitan court are subject to all laws and regulations
|
0011| applicable to state officers and agencies and state officers
|
0012| and employees, except where otherwise specifically provided by
|
0013| law.
|
0014| C. There shall be [fifteen] eighteen judges of
|
0015| the Bernalillo county metropolitan court."
|
0016| Section 4. APPROPRIATIONS.--
|
0017| A. The amounts specified in Subsections B through S
|
0018| of this section are appropriated from the general fund to the
|
0019| following courts or judicial agencies for expenditure in fiscal
|
0020| year 1998 to supplement the fiscal year 1998 base budget or to
|
0021| expand the base budget for a specified purpose. Any unexpended
|
0022| or unencumbered balance remaining at the end of fiscal year
|
0023| 1998 shall revert to the general fund.
|
0024| B. The following is appropriated to the
|
0025| administrative office of the courts:
|
0001| (1) two hundred twenty-five thousand dollars
|
0002| ($225,000) for supplemental funding;
|
0003| (2) one million dollars ($1,000,000) for
|
0004| supplemental funding of the statewide court automation project;
|
0005| (3) two hundred thousand dollars ($200,000)
|
0006| for a judicial performance evaluation project;
|
0007| (4) one million dollars ($1,000,000) for
|
0008| supplemental funding of the court-appointed attorney fees fund;
|
0009| (5) five hundred sixty-three thousand dollars
|
0010| ($563,000) for supplemental funding of the jury and witness fee
|
0011| fund; and
|
0012| (6) one million four hundred sixty-eight
|
0013| thousand dollars ($1,468,000) for supplemental funding of the
|
0014| magistrate courts.
|
0015| C. Forty-five thousand dollars ($45,000) is
|
0016| appropriated to the supreme court for supplemental funding.
|
0017| D. Ninety-five thousand dollars ($95,000) is
|
0018| appropriated to the court of appeals for supplemental funding.
|
0019| E. Two hundred three thousand dollars ($203,000) is
|
0020| appropriated to the supreme court law library for supplemental
|
0021| funding.
|
0022| F. Sixty-four thousand dollars ($64,000) is
|
0023| appropriated to the supreme court building commission for
|
0024| supplemental funding.
|
0025| G. The following is appropriated to the first
|
0001| judicial district:
|
0002| (1) one hundred forty-three thousand dollars
|
0003| ($143,000) for supplemental funding;
|
0004| (2) fifty-five thousand dollars ($55,000) for
|
0005| treatment funds for the drug court; and
|
0006| (3) three hundred thousand dollars ($300,000)
|
0007| for salaries and benefits, furniture, equipment and supplies
|
0008| for one additional judge and his staff.
|
0009| H. The following is appropriated to the second
|
0010| judicial district:
|
0011| (1) eight hundred eighty thousand dollars
|
0012| ($880,000) for supplemental funding;
|
0013| (2) one million two hundred thousand dollars
|
0014| ($1,200,000) to expand the drug court, including salaries and
|
0015| benefits, furniture, equipment and supples for one additional
|
0016| judge for the drug court and his staff; and
|
0017| (3) three hundred thousand dollars ($300,000)
|
0018| for salaries and benefits, furniture, equipment and supples for
|
0019| one additional second judicial district judge and his staff.
|
0020| I. Two hundred five thousand dollars ($205,000) is
|
0021| appropriated to the third judicial district for supplemental
|
0022| funding.
|
0023| J. Four hundred forty-seven thousand dollars
|
0024| ($447,000) is appropriated to the fifth judicial district for
|
0025| supplemental funding.
|
0001| K. Forty-nine thousand dollars ($49,000) is
|
0002| appropriated to the sixth judicial district for supplemental
|
0003| funding.
|
0004| L. Forty-seven thousand dollars ($47,000) is
|
0005| appropriated to the seventh judicial district for supplemental
|
0006| funding.
|
0007| M. One hundred twelve thousand dollars ($112,000)
|
0008| is appropriated to the eighth judicial district for
|
0009| supplemental funding.
|
0010| N. Fourteen thousand dollars ($14,000) is
|
0011| appropriated to the ninth judicial district for supplemental
|
0012| funding.
|
0013| O. Fifty-nine thousand dollars ($59,000) is
|
0014| appropriated to the tenth judicial district for supplemental
|
0015| funding.
|
0016| P. Ninety-three thousand dollars ($93,000) is
|
0017| appropriated to the eleventh judicial district for supplemental
|
0018| funding.
|
0019| Q. One hundred thirteen thousand dollars ($113,000)
|
0020| is appropriated to the twelfth judicial district for
|
0021| supplemental funding.
|
0022| R. One hundred sixteen thousand dollars ($116,000)
|
0023| is appropriated to the thirteenth judicial district for
|
0024| supplemental funding.
|
0025| S. The following is appropriated to the Bernalillo
|
0001| county metropolitan court:
|
0002| (1) eight hundred thousand dollars ($800,000)
|
0003| for supplemental funding; and
|
0004| (2) one million four hundred thousand dollars
|
0005| ($1,400,000) for salaries and benefits, furniture, equipment
|
0006| and supplies for three additional judges and their staff.
