GARCIA | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO THE LEGAL PROFESSION; AUTHORIZING THE NEW MEXICO | 0012| STATE POLICE TO OBTAIN FINGERPRINTS OF APPLICANTS TO THE STATE | 0013| BAR FROM THE FEDERAL BUREAU OF INVESTIGATION; AUTHORIZING THE | 0014| NEW MEXICO STATE POLICE TO PROVIDE THE NEW MEXICO BOARD OF BAR | 0015| EXAMINERS WITH CRIMINAL HISTORY RECORDS OF APPLICANTS; AMENDING | 0016| A SECTION OF THE NMSA 1978. | 0017| | 0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0019| Section 1. Section 29-3-1 NMSA 1978 (being Laws 1935, | 0020| Chapter 149, Section 4, as amended) is amended to read: | 0021| "29-3-1. NEW MEXICO STATE POLICE--IDENTIFICATION AND | 0022| INFORMATION.-- | 0023| A. It [shall be] is the duty of the New Mexico | 0024| state police to install and maintain complete systems for the | 0025| identification of criminals, including the fingerprint system | 0001| and the modus operandi system. The New Mexico state police | 0002| shall obtain, from whatever source procurable, and shall file | 0003| and preserve for record, [such] plates, photographs, outline | 0004| pictures, fingerprints, measurements, descriptions, modus | 0005| operandi statements and such other information [about, | 0006| concerning and] relating to any and all persons who have been | 0007| or who shall [hereafter] be convicted of a felony or who | 0008| shall attempt to commit a felony within this state or who are | 0009| well-known and habitual criminals or who have been convicted of | 0010| any of the following felonies or misdemeanors: | 0011| (1) illegally carrying, concealing or | 0012| possessing a pistol or any other dangerous weapon; | 0013| (2) buying or receiving stolen property; | 0014| (3) unlawful entry of a building; | 0015| (4) escaping or aiding an escape from | 0016| prison; | 0017| (5) making or possessing a fraudulent or | 0018| forged check or draft; | 0019| (6) petit larceny; and | 0020| (7) unlawfully possessing or distributing | 0021| habit-forming narcotic drugs. | 0022| B. The New Mexico state police may also obtain like | 0023| information concerning persons who have been convicted of | 0024| violating any of the military, naval or criminal laws of the | 0025| United States or who have been convicted of a crime in any | 0001| other state, country, district or province [which] that, if | 0002| committed within this state, would be a felony. | 0003| C. The New Mexico state police may obtain, at the | 0004| applicant's expense, fingerprints of applicants to the New | 0005| Mexico state bar from the federal bureau of investigation | 0006| pursuant to the provisions of Public Law 92-544 or any other | 0007| applicable federal law. The New Mexico state police may | 0008| provide the New Mexico board of bar examiners with criminal | 0009| history records for applicants to the New Mexico state bar. | 0010| [C.] D.
