0011|     RELATING TO LIQUEFIED PETROLEUM GASES; ENACTING A SECTION OF
    |
0012|     THE LPG AND CNG ACT PERTAINING TO RESPONSIBILITIES AND
    |
0013|     LIABILITY OF DISTRIBUTORS OF LIQUEFIED PETROLEUM GASES FOR GAS
    |
0014|     DISTRIBUTION EQUIPMENT.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  A new section of the LPG and CNG Act is
    |
0018|     enacted to read:
    |
0019|          "[<u>NEW MATERIAL</u>]  GAS DISTRIBUTION EQUIPMENT--
    |
0020|     RESPONSIBILITIES--DISTRIBUTOR LIABILITY.--
    |
0021|               A.  A distributor shall operate and maintain in
    |
0022|     safe, efficient and proper condition all of its gas
    |
0023|     distribution equipment up to and including the point of
    |
0024|     delivery into the piping owned by the consumer.  Unless
    |
0025|     otherwise agreed in writing by the distributor and the
    |
0001|     consumer, the point of delivery shall be at the outflow side of
    |
0002|     the first stage regulator.
    |
0003|               B.  A consumer shall operate and maintain in safe,
    |
0004|     efficient and proper condition all gas distribution equipment
    |
0005|     that is not the responsibility of a distributor under
    |
0006|     Subsection A of this section.
    |
0007|               C.  No liability shall be imposed on a distributor
    |
0008|     in any action at law for failure to inspect, check, repair or
    |
0009|     maintain gas distribution equipment that is the responsibility
    |
0010|     of the consumer under Subsection B of this section.
    |
0011|               D.  As used in this section:
    |
0012|                    (1)  "consumer" means any person or entity who
    |
0013|     purchases liquefied petroleum gases from a distributor; 
    |
0014|                    (2)  "distributor" means any person or entity
    |
0015|     engaged in the sale, marketing or distribution of liquefied
    |
0016|     petroleum gases; and
    |
0017|                    (3)  "gas distribution equipment" means any
    |
0018|     containers, regulators, piping, valves, controls or appliances
    |
0019|     used or intended for use for the storage, distribution or use
    |
0020|     of liquefied petroleum gases."
