0013| RELATING TO PUBLIC SCHOOLS; CREATING A STUDENT ATTENDANCE
|
0014| OVERSIGHT TASK FORCE; MAKING AN APPROPRIATION.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. STUDENT ATTENDANCE OVERSIGHT TASK FORCE--
|
0018| CREATION--TERMINATION.--The "student attendance oversight task
|
0019| force" is created. The task force shall function from the date
|
0020| of its appointment until the first day of December prior to the
|
0021| second session of the forty-third legislature.
|
0022| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0023| A. The student attendance oversight task force
|
0024| shall be composed of six legislative members; six public
|
0025| advisory members, two of whom shall be graduates of or current
|
0001| students at an alternative high school in the state; and one
|
0002| representative from the state department of public education.
|
0003| B. Three members of the house of representatives
|
0004| shall be appointed by the speaker of the house of
|
0005| representatives and three members of the senate shall be
|
0006| appointed by the committees' committee of the senate or, if the
|
0007| senate appointments are made in the interim, by the president
|
0008| pro tempore of the senate after consultation with and the
|
0009| agreement of a majority of the members of the committees'
|
0010| committee. Members shall be appointed from each house so as to
|
0011| give the two major political parties in each house the same
|
0012| proportional representation on the task force as prevails in
|
0013| each house; however, in no event shall either party have less
|
0014| than one member from each house on the task force. Vacancies
|
0015| on the task force shall be filled by appointment in the same
|
0016| manner as the original appointments.
|
0017| C. So as to represent the state's ethnic and
|
0018| geographic diversity, three public advisory members shall be
|
0019| appointed to the task force by the speaker of the house of
|
0020| representatives and three public advisory members shall be
|
0021| appointed to the task force by the president pro tempore of the
|
0022| senate. The public members of the task force shall be paid per
|
0023| diem and mileage in accordance with the provisions of the Per
|
0024| Diem and Mileage Act plus reimbursement for reasonable actual
|
0025| expenses.

0001| D. The task force shall also include one advisory
|
0002| member representing the state department of public education
|
0003| appointed by the president of the state board of education.
|
0004| E. The speaker of the house of representatives and the
|
0005| president pro tempore of the senate shall each designate one co-
|
0006| chairman of the task force.
|
0007| Section 3. DUTIES.--
|
0008| A. After its appointment, the student attendance
|
0009| oversight task force shall hold one organizational meeting to
|
0010| develop a work plan and budget for the ensuing interim. The work
|
0011| plan and budget shall be submitted to the New Mexico legislative
|
0012| council for approval.
|
0013| B. Upon approval of the work plan and budget by the
|
0014| legislative council, the task force shall oversee the
|
0015| implementation of the legislative directives relating to the
|
0016| student attendance and graduation, including development of a
|
0017| method to allocate the funds which each school district receives
|
0018| under the state equalization guarantee to create incentives to
|
0019| improve the student attendance and graduation rate.

0020| C. The task force shall recommend legislation or
|
0021| changes if any are found to be necessary to the legislature.
|
0022| Section 4. REPORT.--The student attendance oversight task
|
0023| force shall make a report of its findings and recommendations for
|
0024| the consideration of the second session of the forty-third
|
0025| legislature. The reports and suggested legislation shall be made
|
0001| available to the New Mexico legislative council on or before
|
0002| November 1 preceding the session.

0003| Section 5. STAFF.--The staff for the student attendance
|
0004| oversight task force shall be provided by the legislative council
|
0005| service.
|
0006| Section 6. APPROPRIATION.--twenty thousand dollars
|
0007| ($20,000) is appropriated from the general fund to the legislative
|
0008| council service for expenditure in fiscal year 1998 for the
|
0009| purpose of paying the salaries and expenses of technical, legal
|
0010| and clerical staff; for purchasing equipment and supplies; and for
|
0011| reimbursing the per diem and mileage expenses of the student
|
0012| attendance oversight task force members. Any unexpended or
|
0013| unencumbered balance remaining at the end of fiscal year 1998
|
0014| shall revert to the general fund.
