0001| SENATE BILL 793 | 0002| 43rd legislature - STATE OF NEW MEXICO - first session, 1997 | 0003| INTRODUCED BY | 0004| CYNTHIA NAVA | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| MAKING AN APPROPRIATION TO THE BOARD OF REGENTS OF THE | 0012| UNIVERSITY OF NEW MEXICO FOR THE PURPOSE OF EVALUATING AND | 0013| REPORTING ON GROWTH IMPACTS AND ISSUES IN CERTAIN NEW MEXICO | 0014| COMMUNITIES EXPERIENCING HIGH GROWTH; DECLARING AN EMERGENCY. | 0015| | 0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0017| Section 1. TEMPORARY PROVISION.-- | 0018| A. The appropriation provided in Section 2 of this | 0019| act is to be used by the university of New Mexico school of | 0020| architecture and planning to investigate, study and report on | 0021| growth issues and impacts in six New Mexico communities, | 0022| counties or regions subject to high growth rates. The | 0023| evaluation shall: | 0024| (1) investigate different types of growth in | 0025| New Mexico and their particular impacts on communities, natural | 0001| resources, people and public and private facilities and | 0002| infrastructure, as well as limits and issues related to | 0003| potential future growth; | 0004| (2) investigate the fiscal impacts of growth | 0005| on state, county and local taxpayers and local, county and | 0006| state government in the selected growth areas; | 0007| (3) investigate the efficacy and | 0008| appropriateness of existing enabling laws related to | 0009| development and land use, such as zoning regulation, historic | 0010| districts and landmarks, subdivisions and planning and | 0011| platting, annexation of territory, regional planning, community | 0012| development and urban development; | 0013| (4) investigate problems such as the need for | 0014| regional cooperation and the relationship between the planning | 0015| and development review and approval that may not be addressed | 0016| by the existing laws; | 0017| (5) investigate policies and processes that | 0018| would help: | 0019| (a) provide more certainty in | 0020| determining where new development should and should not occur; | 0021| (b) make more efficient use of land that | 0022| has already been developed, including a strong focus on job | 0023| creation and housing in established urban areas; | 0024| (c) establish a legal and procedural | 0025| framework to create desired certainty and send appropriate | 0001| economic signals to investors; and | 0002| (d) include communities, people and | 0003| government in the process of managing future growth that may | 0004| affect them; and | 0005| (6) consider the effects that such policies | 0006| might have if applied or not applied in areas of the state | 0007| experiencing slower growth. | 0008| B. The university of New Mexico school of | 0009| architecture and planning shall coordinate this comprehensive | 0010| evaluation with and seek appropriate involvement and support | 0011| from the university of New Mexico bureau of business and | 0012| economic research and the university of New Mexico institute of | 0013| public law. The university of New Mexico may contract with | 0014| appropriate professional to assist in the evaluation. | 0015| C. The comprehensive evaluation shall include a | 0016| written report to be presented to the appropriate interim | 0017| legislative committee no later than December 1, 1997. The | 0018| comprehensive evaluation shall also include a public | 0019| presentation of its findings and conclusions no later than | 0020| December 31, 1997. | 0021| Section 2. APPROPRIATION.--One hundred thousand dollars | 0022| ($100,000) is appropriated from the general fund to the board | 0023| of regents of the university of New Mexico for expenditure in | 0024| fiscal years 1997 and 1998 for the purpose of funding a study | 0025| by the school of architecture and planning to evaluate and | 0001| report on growth impacts and issues in six New Mexico | 0002| communities, counties or regions experiencing high growth. Any | 0003| unexpended or unencumbered balance remaining at the end of | 0004| fiscal year 1998 shall revert to the general fund. | 0005| Section 3. EMERGENCY.--It is necessary for the public | 0006| peace, health and safety that this act take effect immediately. | 0007|  | 0008| |
