0011|     RELATING TO HEALTH CARE; PROVIDING MEDICAID PROGRAM PAYMENTS TO

0012|     FEDERALLY QUALIFIED HEALTH CENTERS; ENACTING A NEW SECTION OF

0013|     THE PUBLIC ASSISTANCE ACT.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of the Public Assistance Act is
    |
0017|     enacted to read:
    |
0018|          "[<u>NEW MATERIAL</u>]  PAYMENTS UNDER MEDICAID TO FEDERALLY
    |
0019|     QUALIFIED HEALTH CENTERS.--
    |
0020|               A.  In providing payments under the medicaid
    |
0021|     program, the department shall ensure that an entity that was or
    |
0022|     would have qualified as a federally qualified health center in
    |
0023|     1996 under the federal act, as defined in 42 U.S.C. Section
    |
0024|     1396d (l) (2), shall receive one hundred percent reasonable
    |
0025|     cost-based reimbursement for services, as was provided in the
    |
0001|     federal act during 1996 for the centers pursuant to the
    |
0002|     provisions of 42 U.S.C. Section 1396a (a) (13) (E).
    |
0003|               B.  In administering the medicaid program, the
    |
0004|     department shall ensure that any managed care program for
    |
0005|     medicaid, whether implemented through a federal waiver, block
    |
0006|     grant or otherwise, shall require each health plan
    |
0007|     participating in the medicaid managed care program to contract
    |
0008|     with each entity in its service area that was or would have
    |
0009|     qualified as a federally qualified health center in 1996 under
    |
0010|     the federal act,  as defined in 42 U.S.C. Section 1396d (l)
    |
0011|     (2),  for delivery of covered services at terms no less
    |
0012|     favorable than those offered to other providers in the plan for
    |
0013|     equivalent services.  The department shall provide timely
    |
0014|     payments at least quarterly to federally qualified health
    |
0015|     centers to cover the difference between their one hundred
    |
0016|     percent reasonable costs, as was provided in the federal act
    |
0017|     during 1996 for the centers pursuant to the provisions of 42
    |
0018|     U.S.C. Section 1396a (a) (13) (E), and the payments under
    |
0019|     medicaid managed care that are received by the federally
    |
0020|     qualified health centers."
