Section 12-5-2 NMSA 1978 (being Laws 1969, | 0018| Chapter 114, Section 1, as amended by Laws 1987, Chapter 3, | 0019| Section 1 and also by Laws 1987, Chapter 309, Section 1) is | 0020| amended to read: | 0021| "12-5-2. LEGAL HOLIDAYS--DESIGNATION.--Legal public | 0022| holidays in New Mexico are: | 0023| A. New Year's day, January 1; | 0024| B. Martin Luther King, Jr.'s birthday, third Monday | 0025| in January; | 0001| C. Washington's and Lincoln's birthday, President's | 0002| day, third Monday in February; | 0003| D. Cesar E. Chavez Day, last Monday in March; | 0004| [D.] E. Memorial day, last Monday in May; | 0005| [E.] F. Independence day, July 4; | 0006| [F.] G. Labor day, first Monday in September; | 0007| [G.] H. Columbus day, second Monday in October; | 0008| [H.] I. Armistice day and Veterans' day, | 0009| November 11; | 0010| [I.] J. Thanksgiving day, fourth Thursday in | 0011| November; and | 0012| [J.] K. Christmas day, December 25." | 0013| Section 2. [NEW MATERIAL] CESAR ESTRADA CHAVEZ | 0014| COMMISSION--CREATED--DEFINED--MEMBERS--TERMS--COMPENSATION.-- | 0015| A. The "Cesar Estrada Chavez commission" is | 0016| created. The purpose of the commission is to develop, promote, | 0017| coordinate and review statewide plans and activities for the | 0018| annual commemoration and celebration of the birthday of Cesar | 0019| Estrada Chavez in accordance with Section 12-5-2 NMSA 1978. | 0020| B. As used in Sections 2 through 5 of this act, | 0021| "commission" means the Cesar Estrada Chavez commission. | 0022| C. The commission shall be comprised of thirteen | 0023| members as follows: | 0024| (1) four members appointed by the governor; | 0025| (2) one member appointed by the president pro | 0001| tempore of the senate; | 0002| (3) one member appointed by the minority | 0003| leader of the senate; | 0004| (4) one member appointed by the speaker of the | 0005| house of representatives; | 0006| (5) one members appointed by the minority | 0007| leader of the house of representatives; | 0008| (6) the state treasurer or his designee; | 0009| (7) the secretary of state or his designee; | 0010| (8) a Native American appointed by the New | 0011| Mexico office of Indian affairs; | 0012| (9) the director of the human rights division | 0013| of the labor department or his designee; and | 0014| (10) the chairman of the state corporation | 0015| commission or his designee. | 0016| D. Members of the commission shall be appointed | 0017| initially for terms as follows: seven members shall be | 0018| appointed for terms of two years and six members shall be | 0019| appointed for terms of four years. The initial terms shall be | 0020| determined by random drawing. After the expiration of the | 0021| initial terms, all members shall be appointed for four-year | 0022| terms. The initial commission shall be appointed within forty- | 0023| five days from the effective date of this act. Vacancies | 0024| resulting from the death or resignation of a member shall be | 0025| filled by appointment by the commission chairman for the | 0001| unexpired portion of the term of the member creating the | 0002| vacancy. In filling any vacancy, the commission chairman may | 0003| accept recommendations from the person who originally appointed | 0004| the member creating the vacancy. | 0005| E. The members of the commission shall receive no | 0006| compensation for their service. | 0007| F. The members of the commission shall select a | 0008| chairman from the members of the commission. | 0009| G. The commission shall appoint an executive | 0010| director to coordinate all activities on the commission's | 0011| behalf. | 0012| Section 3. [NEW MATERIAL] CESAR ESTRADA CHAVEZ FUND-- | 0013| CREATED.-- | 0014| A. There is created within the state treasury for | 0015| the commission a fund that shall be designated as the "Cesar | 0016| Estrada Chavez fund" that shall consist of appropriations, | 0017| endowments and bequests. | 0018| B. Money from the fund shall be disbursed upon | 0019| warrant of the secretary of finance and administration pursuant | 0020| to vouchers submitted by the executive director of the | 0021| commission for the purpose of carrying out the provisions of | 0022| this act. | 0023| Section 4. [NEW MATERIAL] DUTIES OF THE COMMISSION.-- | 0024| The duties of the commission shall include the following: | 0025| A. to develop a plan for the commemoration and | 0001| celebration of the official legal holiday honoring Cesar | 0002| Estrada Chavez; | 0003| B. to develop and submit to the governor and the | 0004| legislature recommendations for specific commemorative | 0005| activities to be undertaken by the state for the Cesar Estrada | 0006| Chavez holiday; | 0007| C. to coordinate state plans and activities with | 0008| federal plans and activities for the commemoration and | 0009| celebration of the Cesar Estrada Chavez holiday; | 0010| D. to develop, with other agencies of the state, an | 0011| interpretive program that explores the historical, social, | 0012| political and cultural themes associated with the life and | 0013| works of Cesar Estrada Chavez; | 0014| E. to develop and acquire interpretive materials | 0015| and publications on the significance of Cesar Estrada Chavez' | 0016| work and develop a commemorative program for state employees, | 0017| school children and the general public; | 0018| F. to create a process to facilitate the | 0019| implementation of the master plan project and other | 0020| recommendations made by the commission; | 0021| G. to prepare and provide to the general public | 0022| advice, assistance and information on the Cesar Estrada Chavez | 0023| holiday activities recommended by the commission; | 0024| H. to submit other studies, reports and | 0025| recommendations to the governor and the legislature as are | 0001| necessary with respect to activities for the continued | 0002| commemoration and celebration of Cesar Estrada Chavez; and | 0003| I. to accept endowments and bequests for the Cesar | 0004| Estrada Chavez fund. | 0005| Section 5. COMMISSION REPORT.--The commission shall make | 0006| an initial report to the governor and the legislature of its | 0007| findings, conclusions, proposals and recommendations for the | 0008| observance of the Cesar Estrada Chavez holiday within ninety | 0009| days of the effective date of this act. The commission shall | 0010| submit an annual report of its activities to the legislature no | 0011| later than December 1 of each year. The first annual report | 0012| shall be submitted no later than December 1, 1997. | 0013| Section 6.
