SHORT TITLE.--This act may be cited as the | 0018| "Rio Grande Bosque Management Act". | 0019| Section 2. LEGISLATIVE FINDINGS.-- | 0020| A. The legislature finds that the Rio Grande bosque | 0021| is an important natural resource that is undergoing rapid | 0022| ecological change that endangers the future existence of native | 0023| biological communities, especially riparian gallery forests of | 0024| cottonwood and willow. | 0025| B. The institutional structure that manages the | 0001| middle Rio Grande is composed of many federal, state, local and | 0002| tribal entities that often operate independently to address | 0003| irrigation, flood control, drainage needs, recreation, law | 0004| enforcement and wildlife management without complete | 0005| coordination to achieve ecosystem management and the balancing | 0006| of compatible uses of the bosque. | 0007| C. Those portions of the middle Rio Grande bosque | 0008| that lie within Indian reservations are subject to management | 0009| by individual Indian governments as sovereign entities. | 0010| D. The middle Rio Grande conservancy district is | 0011| one of the primary entities charged with managing the bosque | 0012| and will play a major role in the coordination of ecosystem | 0013| management. | 0014| Section 3. DEFINITION.--As used in the Rio Grande Bosque | 0015| Management Act, "bosque" means: | 0016| A. all land between the flood control levees, | 0017| excepting the levees themselves, and the river bank from | 0018| Cochiti reservoir to Elephant Butte reservoir, provided that | 0019| where there are no levees, bosque includes the following: | 0020| (1) where there is a riverside drain, such | 0021| lands as exist between the riverside drain, excepting the | 0022| riverside drain itself, and the river bank; or | 0023| (2) where there is no riverside drain, the | 0024| lands between the river bank and the limits of the historic | 0025| flood plain; and | 0001| B. all other lands that are ecological components | 0002| of the middle Rio Grande riparian system, provided that the | 0003| owners of the lands voluntarily agree to allow the Rio Grande | 0004| bosque advisory council to offer suggestions for their | 0005| management. | 0006| Section 4. RIO GRANDE BOSQUE ADVISORY COUNCIL--CREATED-- | 0007| MEMBERS.-- | 0008| A. The "Rio Grande bosque advisory council" is | 0009| created to advise public and private landowners with the bosque | 0010| as defined above, to promote coordination among all government | 0011| agencies having authority in the bosque and to promote the | 0012| protection and enhancement of bosque and river ecosystems. | 0013| B. The Rio Grande bosque advisory council may | 0014| consist of the following members or their designees as voting | 0015| members according to the following categories: | 0016| (1) the mayors of Albuquerque, Belen, | 0017| Bernalillo, Bosque Farms, Corrales, Los Lunas, Los Ranchos de | 0018| Albuquerque, Rio Rancho and Socorro; | 0019| (2) the county commission chairmen from | 0020| Bernalillo, Sandoval, Socorro and Valencia counties; | 0021| (3) the governors of the following pueblos: | 0022| Cochiti, Isleta, Sandia, San Felipe, Santa Ana and Santo | 0023| Domingo; | 0024| (4) one representative each from the United | 0025| States army corps of engineers, the bureau of reclamation, the | 0001| natural resources conservation service and the United States | 0002| fish and wildlife service; | 0003| (5) a representative of the middle Rio Grande | 0004| conservancy district; | 0005| (6) the secretary of energy, minerals and | 0006| natural resources, the secretary of environment, the director | 0007| of the department of game and fish, the state engineer, the | 0008| commissioner of public lands and the chairman of the interstate | 0009| stream commission; | 0010| (7) two private bosque landowners nominated by | 0011| the landowner committee; and | 0012| (8) one representative of a local organization | 0013| in the middle Rio Grande region that is dedicated to protection | 0014| and enhancement of the bosque or the river and one | 0015| representative of a regional or national environmental | 0016| organization. The environmental representatives shall be | 0017| designated by the speaker of the house of representatives and | 0018| the president pro tempore of the senate and shall be | 0019| individuals who have an established knowledge of issues | 0020| affecting the river and the bosque and who have been involved | 0021| in attempting to protect and enhance bosque and river | 0022| ecosystems. | 0023| C. The business of the Rio Grande bosque advisory | 0024| council between meetings shall be conducted by an eight-member | 0025| executive committee, with one member selected from each | 0001| category of membership as set forth in Subsection B of this | 0002| section. | 0003| D. The secretary of energy, minerals and natural | 0004| resources or his designee shall serve as the chairman of the | 0005| Rio Grande bosque advisory council for the first fiscal year of | 0006| the council, and thereafter a chairman shall be elected by the | 0007| membership of the council. | 0008| E. The Rio Grande bosque advisory council shall | 0009| hold at least two open meetings each year. The executive | 0010| committee shall meet as needed. The council shall promulgate | 0011| public notice of each meeting and provide interested members of | 0012| the public with the opportunity to present written and oral | 0013| comments. | 0014| F. The Rio Grande bosque advisory council is | 0015| administratively attached to the energy, minerals and natural | 0016| resources department but shall have authority, independent of | 0017| the department, to carry out its assigned functions as defined | 0018| by the Rio Grande Bosque Management Act. | 0019| G. Members of the Rio Grande bosque advisory | 0020| council not otherwise eligible shall receive per diem and | 0021| mileage as provide for nonsalaried public officers in the Per | 0022| Diem and Mileage Act and shall receive no other compensation, | 0023| perquisite or allowance. | 0024| Section 5. COUNCIL--POWERS AND DUTIES.-- | 0025| A. The Rio Grande bosque advisory council shall | 0001| adopt, after a public hearing, a set of principles to advise | 0002| appropriate government agencies on actions that may affect the | 0003| bosque. The principles shall be based on the concept that the | 0004| bosque is an integrated system of biological, physical, social | 0005| and cultural components. The principles shall encourage the | 0006| protection and enhancement of bosque and river ecosystems, and | 0007| in formulating the principles, the council shall review, | 0008| implement and update to the extent possible the recommendations | 0009| from the report, "middle rio grande ecosystem: bosque | 0010| conservation of the middle rio grande bosque". | 0011| B. The Rio Grande bosque council shall act as | 0012| advisory council to the middle Rio Grande conservancy district | 0013| regarding the management of bosque lands within the boundaries | 0014| of the district. The council shall also advise other | 0015| management authorities, landowners and regulatory agencies that | 0016| own, control or exercise authority within the bosque. | 0017| C. The Rio Grande bosque advisory council shall | 0018| request participating agencies to enter into a memorandum of | 0019| agreement for cooperation in implementing the set of principles | 0020| established pursuant to Subsection A of this section and in | 0021| undertaking coordinated resource management programs for the | 0022| bosque. | 0023| D. The Rio Grande bosque advisory council shall: | 0024| (1) maintain information on the biological, | 0025| physical, social and cultural conditions in the bosque; | 0001| (2) establish an information clearinghouse for | 0002| public comment and distribution of information to the public; | 0003| (3) foster mediation to resolve conflicts and | 0004| disputes regarding the bosque; | 0005| (4) publish an annual "state of the bosque | 0006| report" and report annually to the appropriate interim | 0007| committees of the legislature and to the board of the middle | 0008| Rio Grande conservancy district; and | 0009| (5) establish committees to assist it, | 0010| composed of members of the council and members of the public. | 0011| One committee shall be a landowner committee and one shall be a | 0012| committee composed of private citizens. The citizen committee | 0013| shall have authority to consider any and all matters affecting | 0014| the welfare of the bosque and to receive oral and written | 0015| public comments. Prior to the issuance of the council's state | 0016| of the bosque report, the citizen committee shall submit a | 0017| written report and recommendations for the council's | 0018| consideration. The council shall review the citizen | 0019| committee's report and recommendations for possible | 0020| incorporation into the state of the bosque report. | 0021| E. In order to carry out its duties, the Rio Grande | 0022| bosque advisory council shall have the following powers: | 0023| (1) adopt bylaws to govern the structure and | 0024| operations of the council and council meetings; | 0025| (2) solicit and administer grants and in-kind | 0001| services and use its funds as the local cost share to obtain | 0002| federal funding for projects to assist it in carrying out its | 0003| obligations under the Rio Grande Bosque Management Act; and | 0004| (3) sponsor mediation services. | 0005| Section 6. EXECUTIVE COMMITTEE--POWERS AND DUTIES.--The | 0006| executive committee of the Rio Grande bosque advisory council | 0007| shall: | 0008| A. employ and fix the compensation of those | 0009| employees necessary to discharge the duties of the council; | 0010| B. set executive committee and full council meeting | 0011| dates, locations and agendas; | 0012| C. prepare draft advisory principles on government | 0013| actions that affect the bosque, taking into consideration the | 0014| reports and recommendations of the council and the citizen and | 0015| landowner committees; | 0016| D. prepare and disseminate an annual "state of the | 0017| bosque report"; | 0018| E. develop an annual budget; and | 0019| F. be subject to the provisions of the Open | 0020| Meetings Act. | 0021| Section 7. APPROPRIATION.--One hundred thousand dollars | 0022| ($100,000) is appropriated from the general fund to the energy, | 0023| minerals and natural resources department for expenditure in | 0024| fiscal year 1998 for the purpose of establishing the Rio Grande | 0025| bosque advisory council to coordinate government resource | 0001| management actions of the middle Rio Grande bosque. Any | 0002| unexpended or unencumbered balance remaining at the end of | 0003| fiscal year 1998 shall revert to the general fund. | 0004| Section 8. TERMINATION--DELAYED REPEAL.--The Rio Grande | 0005| bosque advisory council is terminated on July 1, 2007 pursuant | 0006| to the Sunset Act. The council shall continue to operate | 0007| pursuant to the Rio Grande Bosque Management Act until July 1, | 0008| 2008.
