SEVERANCE TAX BONDS--PURPOSES FOR WHICH | 0017| ISSUED--APPROPRIATION OF PROCEEDS.-- | 0018| A. The state board of finance may issue and sell | 0019| severance tax bonds in compliance with the Severance Tax | 0020| Bonding Act in an amount not exceeding nine hundred ninety | 0021| thousand dollars ($990,000) when the state highway and | 0022| transportation department certifies the need for the issuance | 0023| of the bonds. The state board of finance shall schedule the | 0024| issuance and sale of the bonds in the most expeditious and | 0025| economical manner possible upon a finding by the board that the | 0001| project has been developed sufficiently to justify the issuance | 0002| and that the project can proceed to contract within a | 0003| reasonable time. The state board of finance shall further take | 0004| the appropriate steps necessary to comply with the Internal | 0005| Revenue Code of 1986, as amended. The proceeds from the sale | 0006| of the bonds are appropriated to the state highway and | 0007| transportation department in the following amounts for the | 0008| following purposes: | 0009| (1) one hundred thousand dollars ($100,000) to | 0010| reconstruct one-half mile of Corona road between Moongate and | 0011| Weisner road in Dona Ana county; | 0012| (2) thirty thousand dollars ($30,000) to | 0013| reblade and apply double penetration surfacing on one and one- | 0014| half miles of MacArthur road in the Moongate area in Dona Ana | 0015| county; | 0016| (3) one hundred fifty thousand dollars | 0017| ($150,000) to resurface and construct improvements to streets | 0018| in the Butterfield park area of East mesa in Dona Ana county; | 0019| (4) one hundred fifty thousand dollars | 0020| ($150,000) to resurface and construct improvements to two miles | 0021| of streets in Organ in Dona Ana county; | 0022| (5) one hundred fifty thousand dollars | 0023| ($150,000) to reconstruct one mile of Rincon and MacArthur in | 0024| Dona Ana county; | 0025| (6) two hundred thousand dollars ($200,000) to | 0001| surface and improve two and two-thirds miles of Moongate D-069 | 0002| in Dona Ana county; | 0003| (7) one hundred sixty thousand dollars | 0004| ($160,000) to reconstruct eight-tenths of one mile of Kissiah | 0005| drive in Dona Ana county; and | 0006| (8) fifty thousand dollars ($50,000) to | 0007| acquire rights-of-way for the East mesa loop between United | 0008| States highway 70 and the Mesquite interstate 10 interchange. | 0009| B. If the state highway and transportation | 0010| department has not certified the need for the issuance of the | 0011| bonds by the end of fiscal year 1999, the authorization | 0012| provided in this section shall be void. Any unexpended or | 0013| unencumbered balance remaining from the proceeds of severance | 0014| tax bonds issued pursuant to Subsection A of this section at | 0015| the end of fiscal year 2000 shall revert to the severance tax | 0016| bonding fund. | 0017| Section 2. EMERGENCY.--It is necessary for the public | 0018| peace, health and safety that this act take effect immediately. | 0019|  |
