CISNEROS | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING FUNDING FROM | 0012| SEVERANCE TAX BONDS AND OTHER SOURCES FOR CAPITAL PROJECTS IN | 0013| SENATE DISTRICT 6 LOCATED IN MORA, SANTA FE AND TAOS COUNTIES; | 0014| EXPANDING THE PURPOSE OF A 1994 AUTHORIZATION; MAKING | 0015| APPROPRIATIONS; DECLARING AN EMERGENCY. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0019| APPROPRIATION OF PROCEEDS.-- | 0020| A. The state board of finance may issue and sell | 0021| severance tax bonds in compliance with the Severance Tax | 0022| Bonding Act in an amount not to exceed the total of the amounts | 0023| authorized for the purposes specified in this section. The | 0024| state board of finance shall schedule the issuance and sale of | 0025| the bonds in the most expeditious and economical manner | 0001| possible upon a finding by the board that the project has been | 0002| developed sufficiently to justify the issuance and that the | 0003| project can proceed to contract within a reasonable time. The | 0004| state board of finance shall further take the appropriate steps | 0005| necessary to comply with the Internal Revenue Code of 1986, as | 0006| amended. Proceeds from the sale of the bonds are appropriated | 0007| for the purposes specified in this section. The agencies named | 0008| in this section shall certify to the state board of finance | 0009| when the money from the proceeds of the severance tax bonds | 0010| authorized in this section is needed for the purposes specified | 0011| in the applicable subsections of this section. Appropriation | 0012| of the proceeds for each purpose is subject to the limitations, | 0013| when applicable, provided for in this section. If the | 0014| specified agency has not certified the need for the issuance of | 0015| the bonds by the end of fiscal year 1999, the authorization | 0016| provided in this section shall be void. Unless otherwise | 0017| specified in this section, any unexpended or unencumbered | 0018| balance remaining from the proceeds of severance tax bonds | 0019| issued pursuant to this section at the end of fiscal year 2000 | 0020| shall revert to the severance tax bonding fund. | 0021| B. Upon certification by the state agency on aging, | 0022| the following amounts are appropriated to the agency for the | 0023| following purposes in Taos county: | 0024| (1) forty thousand dollars ($40,000) to | 0025| purchase a van for the Chamisal senior citizen center; and | 0001| (2) one hundred thousand dollars ($100,000) to | 0002| renovate the Taos pueblo senior citizen center. | 0003| C. Upon certification by the state armory board, | 0004| nine hundred thousand dollars ($900,000) is appropriated to the | 0005| board to construct and equip a national guard armory in Taos | 0006| county. | 0007| D. Upon certification by the state department of | 0008| public education, the following amounts are appropriated to the | 0009| department for the following purposes for Mora independent | 0010| schools: | 0011| (1) two hundred twenty-three thousand nine | 0012| hundred dollars ($223,900) for water system improvements; and | 0013| (2) one hundred twenty thousand eight hundred | 0014| fifty dollars ($120,850) to complete the swimming pool project. | 0015| E. Upon certification by the state department of | 0016| public education, the following amounts are appropriated to the | 0017| department for the following purposes in Taos county: | 0018| (1) for Mesa Vista consolidated school | 0019| district: | 0020| (a) eight hundred thousand dollars | 0021| ($800,000) to complete the construction, equipping and | 0022| furnishing of phases one and two of the lecture hall, music | 0023| classroom and media center capital project; and | 0024| (b) one hundred twenty-five thousand | 0025| dollars ($125,000) for districtwide library acquisitions; | 0001| (2) for Penasco independent schools: | 0002| (a) eighty thousand dollars ($80,000) | 0003| for heating and ventilation improvements to the Penasco high | 0004| school and elementary school buildings; | 0005| (b) one hundred twenty-five thousand | 0006| dollars ($125,000) to reroof the Penasco high school and middle | 0007| school building; and | 0008| (c) one hundred thousand dollars | 0009| ($100,000) to purchase and install three ten thousand gallon | 0010| liquid petroleum gas tanks and to make improvements to the gas | 0011| piping system; | 0012| (3) seven hundred seventy-eight thousand | 0013| dollars ($778,000) to renovate the library, cafeteria area, | 0014| restrooms and classrooms at Questa elementary school; and | 0015| (4) three hundred fifty thousand dollars | 0016| ($350,000) to design and construct four recreation fields and | 0017| related facilities for Taos municipal schools. | 0018| F. Upon certification by the state engineer, the | 0019| following amounts are appropriated to the office of the state | 0020| engineer for the following purposes: | 0021| (1) in Santa Fe county, fifty thousand dollars | 0022| ($50,000) to study Santa Cruz lake, including the Rio del Medio | 0023| and the Rio Frijoles and other tributaries, to determine | 0024| improvements necessary to regain lost capacity; and | 0025| (2) in Taos county: | 0001| (a) fifty-five thousand dollars | 0002| ($55,000) to construct a diversion dam and make improvements to | 0003| the acequia de arriba in El Valle; | 0004| (b) thirty-two thousand dollars | 0005| ($32,000) to purchase a backhoe for the acequias de Chamisal y | 0006| Ojito in Chamisal and Ojito; | 0007| (c) fifty thousand dollars ($50,000) for | 0008| improvements to the acequia of the acequia de Llano de la Yegua | 0009| association; and | 0010| (d) five thousand dollars ($5,000) for | 0011| improvements to the San Cristobal irrigation reservoir of the | 0012| San Cristobal ditch association. | 0013| G. Upon certification by the department of | 0014| environment, the following amounts are appropriated to the | 0015| department for the following purposes: | 0016| (1) in Mora county: | 0017| (a) one million four hundred fifty-five | 0018| thousand dollars ($1,455,000) to construct a sewer treatment | 0019| plant; | 0020| (b) thirty-one thousand five hundred | 0021| dollars ($31,500) to extend sewer lines and install water | 0022| meters for the El Alto sanitary sewer project; | 0023| (c) one million twenty-five thousand | 0024| dollars ($1,025,000) to improve water systems throughout the | 0025| county; and | 0001| (d) one million six hundred forty-seven | 0002| thousand dollars ($1,647,000) to install new wastewater lines | 0003| to the sewer system in Watrous; and | 0004| (2) in Taos county: | 0005| (a) twenty-five thousand dollars | 0006| ($25,000) to water systems in Arroyo Hondo; | 0007| (b) forty thousand dollars ($40,000) to | 0008| plan, develop and construct a water system for the Canon mutual | 0009| domestic water association; | 0010| (c) five hundred twenty-three thousand | 0011| three hundred eighty thousand dollars ($523,380) for a new well | 0012| and other system improvements for the Cerro east community well | 0013| association; | 0014| (d) fifty thousand dollars ($50,000) for | 0015| improvements to the Agua Pura mutual domestic water association | 0016| water system in Chacon; | 0017| (e) one hundred thousand dollars | 0018| ($100,000) for a water hydrology study and to drill a well to | 0019| start a community water system for the El Rito mutual domestic | 0020| water consumers and sewer association; | 0021| (f) two hundred thousand dollars | 0022| ($200,000) for an additional water storage tank for the El | 0023| Prado water and sanitation district; | 0024| (g) six hundred forty-seven thousand | 0025| dollars ($647,000) for water system improvements for La Lama | 0001| mutual domestic water consumers association; | 0002| (h) one hundred fifty thousand dollars | 0003| ($150,000) for a planning study and phase one design for a | 0004| regional water system for Llano Largo, Rodarte, Penasco, Rio | 0005| Lucio, Vadito and Chamisal; | 0006| (i) twenty-five thousand dollars | 0007| ($25,000) for a joint water feasibility study for Penasco, | 0008| Rodarte and Rio Lucio; | 0009| (j) two hundred fifty thousand dollars | 0010| ($250,000) to replace the water storage tank in Penasco; | 0011| (k) seventy-five thousand dollars | 0012| ($75,000) to construct a domestic water well for Questa; | 0013| (l) two hundred thousand dollars | 0014| ($200,000) to expand and improve the Twining water and | 0015| sanitation district's wastewater collection system; and | 0016| (m) one hundred thousand dollars | 0017| ($100,000) for a feasibility study for water and wastewater | 0018| systems in El Valle de Los Ranchos sanitation district. | 0019| H. Upon certification by the state highway and | 0020| transportation department, the following amounts are | 0021| appropriated to the department for the following purposes: | 0022| (1) in Santa Fe county, one hundred thousand | 0023| dollars ($100,000) to pave county roads 91D and 91E, Walnut | 0024| drive and Walnut circle in Sombrillo; | 0025| (2) in Mora county: | 0001| (a) one hundred forty thousand dollars | 0002| ($140,000) to chip seal Mora county road B-015, Tramperos road, | 0003| north to state road 518; | 0004| (b) one hundred thousand dollars | 0005| ($100,000) to chip seal and make drainage improvements to | 0006| Watrous road C-022; | 0007| (c) one hundred thousand dollars | 0008| ($100,000) to chip seal county road A-002 west from the | 0009| junction of state road 94; and | 0010| (d) three hundred thousand dollars | 0011| ($300,000) to chip seal El Alto road A-030; and | 0012| (3) in Taos county: | 0013| (a) one hundred thousand dollars | 0014| ($100,000) to resurface and improve Santa Barbara road; | 0015| (b) one hundred twenty-five thousand | 0016| dollars ($125,000) to complete phase three of the Vallejos road | 0017| project, county road B-060; | 0018| (c) two hundred forty thousand dollars | 0019| ($240,000) to complete phases one and two of the Cuchilla road- | 0020| west Romero road loop project, county roads C-091 and C-087; | 0021| (d) one hundred seventy-five thousand | 0022| dollars ($175,000) to improve lower Las Colonias road, county | 0023| road A-008; and | 0024| (e) one hundred seventy-five thousand | 0025| dollars ($175,000) for design, archaeological services, right- | 0001| of-way acquisition and construction of Blueberry Hill road. | 0002| I. Upon certification by the New Mexico office of | 0003| Indian affairs, one million five hundred thousand dollars | 0004| ($1,500,000) is appropriated to the office to construct, equip | 0005| and furnish an environmental laboratory and training center at | 0006| Taos pueblo. | 0007| J. Upon certification by the local government | 0008| division of the department of finance and administration, the | 0009| following amounts are appropriated to the local government | 0010| division for the following purposes in Mora county: | 0011| (1) six hundred five thousand dollars | 0012| ($605,000) for Americans with Disabilities Act of 1990 and | 0013| electrical, mechanical and building code compliance at the Mora | 0014| county courthouse; | 0015| (2) nine hundred thousand dollars ($900,000) | 0016| to remodel and plan and construct an addition to the Mora | 0017| county courthouse; | 0018| (3) one million five hundred forty thousand | 0019| dollars ($1,540,000) to plan, design and construct a community | 0020| center to house village offices and a community center; | 0021| (4) twenty-five thousand dollars ($25,000) to | 0022| plan, design and construct a road department shop; | 0023| (5) three hundred twenty-five thousand dollars | 0024| ($325,000) to remodel the old jail to accommodate juveniles and | 0025| to purchase police equipment; | 0001| (6) two hundred fifty thousand dollars | 0002| ($250,000) to purchase road equipment; | 0003| (7) two hundred seventy thousand dollars | 0004| ($270,000) to purchase land and design and construct a county | 0005| fairgrounds; | 0006| (8) one hundred twenty-five thousand dollars | 0007| ($125,000) to acquire land and design and construct a park for | 0008| the village of Mora; | 0009| (9) one hundred thousand dollars ($100,000) to | 0010| purchase an ambulance for the village of Mora; | 0011| (10) fifty thousand dollars ($50,000) to | 0012| design and renovate the Wagon Mound municipal building to | 0013| comply with the Americans with Disabilities Act of 1990; | 0014| (11) fifty thousand dollars ($50,000) to | 0015| design and construct a public works building to house emergency | 0016| equipment for the village of Wagon Mound; and | 0017| (12) eighty thousand dollars ($80,000) to | 0018| purchase and equip an ambulance for the village of Wagon Mound. | 0019| K. Upon certification by the local government | 0020| division of the local government department of finance and | 0021| administration, one hundred ninety-five thousand dollars | 0022| ($195,000) is appropriated to the division to purchase and | 0023| equip a class A pumper for the La Puebla fire district in Santa | 0024| Fe county. | 0025| L. Upon certification by the local government | 0001| division of the department of finance and administration, the | 0002| following amounts are appropriated to the local government | 0003| division for the following purposes in Taos county: | 0004| (1) thirty thousand dollars ($30,000) to | 0005| acquire land for a substation in Chamisal; | 0006| (2) one hundred thousand dollars ($100,000) to | 0007| plan, design, construct and equip a community and firehouse | 0008| facility for the community of La Lama; | 0009| (3) sixty thousand dollars ($60,000) to | 0010| acquire land and construct and equip a solid waste transfer | 0011| station in Ojo Caliente; | 0012| (4) fifty thousand dollars ($50,000) to | 0013| design, construct and equip a road department substation in | 0014| Penasco; | 0015| (5) for the village of Red River: | 0016| (a) five hundred thousand dollars | 0017| ($500,000) to design and construct a multipurpose building; and | 0018| (b) one hundred fifty thousand dollars | 0019| ($150,000) to acquire the "little red school house" building | 0020| from the Questa independent school district; | 0021| (6) for the village of Questa: | 0022| (a) one hundred fifty thousand dollars | 0023| ($150,000) to renovate the old senior citizens building to | 0024| serve as a community multipurpose building; | 0025| (b) one hundred five thousand dollars | 0001| ($105,000) to construct a public works maintenance and shop | 0002| building; | 0003| (c) seventy-five thousand dollars | 0004| ($75,000) to construct a pavilion and restrooms and make water | 0005| improvements to the Molycorp Miner memorial park; | 0006| (d) twenty-five thousand dollars | 0007| ($25,000) to acquire and install computer equipment and | 0008| software for village offices; | 0009| (e) fifty thousand dollars ($50,000) to | 0010| match a community development block grant to acquire water | 0011| rights; | 0012| (f) fifty thousand dollars ($50,000) to | 0013| design, construct and equip a road substation; and | 0014| (g) twenty-five thousand dollars | 0015| ($25,000) to construct and maintain an additional FM translator | 0016| station; | 0017| (7) for the town of Taos: | 0018| (a) three hundred fifty thousand dollars | 0019| ($350,000) to construct and equip a youth and family center; | 0020| and | 0021| (b) sixty thousand dollars ($60,000) for | 0022| phase two of a youth construction project at the Taos business | 0023| park, including water catchment system, portal and landscape | 0024| design; and | 0025| (8) for the county of Taos: | 0001| (a) four hundred twenty-five thousand | 0002| dollars ($425,000) to plan, design and construct an adult and | 0003| juvenile detention facility and renovate the existing facility; | 0004| (b) two hundred thousand dollars | 0005| ($200,000) to construct, equip and furnish a public health | 0006| office; | 0007| (c) seventy-five thousand dollars | 0008| ($75,000) to purchase three sheriff's department vehicles; and | 0009| (d) two hundred thousand dollars | 0010| ($200,000) for the county to prepare a master plan on community | 0011| centers. | 0012| M. Upon certification by the local government | 0013| division of the department of finance and administration, three | 0014| hundred thousand dollars ($300,000) is appropriated to the | 0015| local government division for a feasibility study of a proposed | 0016| natural gas infrastructure project for Cordova, Truchas, Ojo | 0017| Sarco, Las Trampas, El Valle, Chamisal, Rio Lucio, Picuris | 0018| pueblo, Penasco, Rodarte, El Llano and Vadito in Taos and Rio | 0019| Arriba counties. | 0020| N. Upon certification of the property control | 0021| division of the general services department, three hundred | 0022| twenty-five thousand dollars ($325,000) is appropriated to the | 0023| capital program fund to construct, equip and furnish an | 0024| addition to the Taos counseling and detoxification center. | 0025| O. Upon certification of the board of regents of | 0001| the university of New Mexico, fifty thousand dollars ($50,000) | 0002| is appropriated to the board of regents for vocational | 0003| equipment and T-1 communications line equipment at the Taos | 0004| center of the university of New Mexico in Taos county. | 0005| Section 2. APPROPRIATION--IRRIGATION WORKS CONSTRUCTION | 0006| FUND.--Eleven thousand dollars ($11,000) is appropriated from | 0007| the irrigation works construction fund to the interstate stream | 0008| commission for expenditure in fiscal years 1997 and 1998 for | 0009| the Saucito ditch dam diversion rehabilitation project. Any | 0010| unexpended or unencumbered balance remaining at the end of | 0011| fiscal year 1998 shall revert to the irrigation works | 0012| construction fund. | 0013| Section 3. SEVERANCE TAX BONDS--EXPANSION OF PURPOSE-- | 0014| REAPPROPRIATION OF BALANCES.--Nineteen thousand five hundred | 0015| thirty-four dollars ($19,534) remaining of the proceeds of the | 0016| sale of severance tax bonds authorized in Paragraph (30) of | 0017| Subsection B of Section 49 of Chapter 148 of Laws 1994 to | 0018| acquire land for a community fire station in Chamisal in Taos | 0019| county is reappropriated to the local government division of | 0020| the department of finance and administration to plan, design, | 0021| construct and equip the Chamisal fire substation. | 0022| Section 4. EMERGENCY.--It is necessary for the public | 0023| peace, health and safety that this act take effect immediately. | 0024|  |
