FIDEL | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0012| SEVERANCE TAX BONDS FOR CAPITAL IMPROVEMENTS IN CIBOLA COUNTY; | 0013| MAKING APPROPRIATIONS; DECLARING AN EMERGENCY. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0017| APPROPRIATION OF PROCEEDS.-- | 0018| A. The state board of finance may issue and sell | 0019| severance tax bonds in compliance with the Severance Tax | 0020| Bonding Act in an amount not to exceed the total of the amounts | 0021| authorized for purposes specified in Sections 2 through 5 of | 0022| this act. The state board of finance shall schedule the | 0023| issuance and sale of the bonds in the most expeditious and | 0024| economical manner possible upon a finding by the board that the | 0025| project has been developed sufficiently to justify the issuance | 0001| and that the project can proceed to contract within a | 0002| reasonable time. The state board of finance shall further take | 0003| the appropriate steps necessary to comply with the Internal | 0004| Revenue Code of 1986, as amended. Proceeds from the sale of | 0005| the bonds are appropriated for the purposes specified in | 0006| Sections 2 through 5 of this act. | 0007| B. The agencies named in Sections 2 through 5 of | 0008| this act shall certify to the state board of finance when the | 0009| money from the proceeds of the severance tax bonds authorized | 0010| in this section is needed for the purposes specified in the | 0011| applicable section of this act. | 0012| C. If the specified agency has not certified the | 0013| need for the issuance of the bonds by the end of fiscal year | 0014| 1999, the authorization provided in this act shall be void. | 0015| D. Unless otherwise specified in this act, any | 0016| unexpended or unencumbered balance remaining from the proceeds | 0017| of severance tax bonds issued pursuant to Sections 2 through 5 | 0018| of this act at the end of fiscal year 2000 shall revert to the | 0019| severance tax bonding fund. | 0020| Section 2. SEVERANCE TAX BONDS--DEPARTMENT OF | 0021| ENVIRONMENT--PURPOSES.--Pursuant to the provisions of Section 1 | 0022| of this act, upon certification by the department of | 0023| environment that the need exists for the issuance of the bonds, | 0024| the following amounts are appropriated to the department of | 0025| environment for the following purposes: | 0001| A. four million dollars ($4,000,000) to develop and | 0002| construct a municipal water supply and sewage disposal system | 0003| at Acoma located in Cibola county; and | 0004| B. two million eight hundred thousand dollars | 0005| ($2,800,000) for improvements to the water system and purchase | 0006| of a water storage tank at Acomita lake located in Cibola | 0007| county. | 0008| Section 3. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND | 0009| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of | 0010| Section 1 of this act, upon certification by the local | 0011| government division of the department of finance and | 0012| administration that the need exists for the issuance of the | 0013| bonds, the following amounts are appropriated to the local | 0014| government division for the following purposes: | 0015| A. six hundred thousand dollars ($600,000) to | 0016| construct a multipurpose recreational facility in the city of | 0017| Grants located in Cibola county; | 0018| B. one hundred fifty thousand dollars ($150,000) to | 0019| purchase three vans equipped with wheelchair lifts and lock- | 0020| downs for the Bethphage mission in the city of Grants located | 0021| in Cibola county; and | 0022| C. two hundred thousand dollars ($200,000) to plan, | 0023| design, construct and make improvements to First street, Second | 0024| street and Roosevelt street in the city of Grants located in | 0025| Cibola county. | 0001| Section 4. SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF | 0002| INDIAN AFFAIRS--PURPOSES.--Pursuant to the provisions of | 0003| Section 1 of this act, upon certification by the New Mexico | 0004| office of Indian affairs that the need exists for the issuance | 0005| of the bonds, the following amounts are appropriated to the New | 0006| Mexico office of Indian affairs for the following purposes: | 0007| A. one million five hundred thousand dollars | 0008| ($1,500,000) to renovate the domestic water distribution system | 0009| at San Jose valley on the pueblo of Laguna located in Cibola | 0010| county; and | 0011| B. three million two hundred thousand dollars | 0012| ($3,200,000) to construct gas distribution lines to the | 0013| villages of Encinal and Paguate on the pueblo of Laguna located | 0014| in Cibola county. | 0015| Section 5. SEVERANCE TAX BONDS--STATE DEPARTMENT OF | 0016| PUBLIC EDUCATION--PURPOSE.--Pursuant to the provisions of | 0017| Section 1 of this act, upon certification by the state | 0018| department of public education that the need exists for the | 0019| issuance of the bonds, five hundred thousand dollars ($500,000) | 0020| is appropriated to the state department of public education for | 0021| the purpose of purchasing computers, printers, electronic | 0022| imaging and video equipment for Grants schools and other Cibola | 0023| county schools. | 0024| Section 6. EMERGENCY.--It is necessary for the public | 0025| peace, health and safety that this act take effect immediately. | 0001|  |
