CARRARO | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO DENTISTRY; AMENDING THE DENTAL HEALTH CARE ACT TO | 0012| ALLOW DENTISTRY LICENSURE BY CREDENTIALS TO PERSONS WITH | 0013| PRACTICAL EXPERIENCE FROM OTHER COUNTRIES. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 61-5A-12 NMSA 1978 (being Laws 1994, | 0017| Chapter 55, Section 12) is amended to read: | 0018| "61-5A-12. DENTISTS--REQUIREMENTS FOR LICENSURE-- | 0019| SPECIALTY LICENSE.-- | 0020| A. All applicants for licensure as a dentist | 0021| [must] shall have graduated and received a diploma from an | 0022| accredited dental college or school of dentistry of a | 0023| university that is accredited by the American dental | 0024| association commission on dental accreditation and have passed | 0025| the written portion of the dental examination administered by | 0001| the joint commission on national dental examinations of the | 0002| American dental association or, if the test is not available, | 0003| [then] another written examination determined by the board. | 0004| B. Applicants for general dentistry licensure by | 0005| examination shall be required, in addition to the requirements | 0006| set forth in Subsection A of this section, to pass a test | 0007| covering the laws and regulations for the practice of dentistry | 0008| in New Mexico. Written examinations shall be supplemented by | 0009| the board or its agents administering to each applicant a | 0010| practical or clinical examination that reasonably tests the | 0011| applicant's qualifications to practice general dentistry. Upon | 0012| an applicant [successfully] passing the written and clinical | 0013| examinations and payment in advance of the necessary fees, the | 0014| board shall issue a license to practice dentistry. | 0015| C. The board may issue a general dentistry license | 0016| by credentials to an applicant who is duly licensed by | 0017| examination as a dentist under the laws of another state or | 0018| territory of the United States. The applicant [must] shall | 0019| meet the same requirements necessary to sit for such | 0020| examination by the board or its examining agents along with | 0021| other qualifications as deemed necessary by regulation of the | 0022| board, including appropriate fees and passing an examination | 0023| covering the laws and regulations of the practice of dentistry | 0024| in New Mexico. | 0025| D. The board may issue a general dentistry license | 0001| by credentials to an applicant who is duly licensed as a | 0002| dentist under the laws of another country if that person has at | 0003| least twenty-five years of practical experience in dentistry in | 0004| the other country. The applicant shall pay the appropriate | 0005| fees and pass an examination covering the laws, rules and | 0006| regulations of the practice of dentistry in New Mexico. | 0007| [D.] E. The board may issue a specialty license | 0008| by examination to an applicant who has [successfully] passed | 0009| a clinical and written examination given by the board or its | 0010| examining agents that covers the applicant's specialty. The | 0011| applicant [must] shall have a postgraduate degree or | 0012| certificate from an accredited dental college, school of | 0013| dentistry of a university or other residency program that is | 0014| accredited by the American dental association commission on | 0015| dental accreditation in one of the specialty areas of dentistry | 0016| recognized by the American dental association. The applicant | 0017| [must] shall also meet all other requirements as | 0018| established by rules and regulations of the board, which | 0019| shall include an examination covering the laws and regulations | 0020| of the practice of dentistry in New Mexico. A specialty | 0021| license limits the licensee to practice only in that specialty | 0022| area. | 0023| [E.] F. The board may issue a specialty license | 0024| by credentials to an applicant who is duly licensed by | 0025| examination as dentist under the laws of another state or | 0001| territory of the United States and has a postgraduate degree or | 0002| certificate from an accredited dental college, school of | 0003| dentistry of a university or other residency program that is | 0004| accredited by the American dental association commission on | 0005| dental accreditation in one of the specialty areas of dentistry | 0006| recognized by the American dental association. The applicant | 0007| [must] shall also meet all other qualifications as deemed | 0008| necessary by [regulation] rules and regulations of the | 0009| board, which shall include an examination covering the laws and | 0010| regulations of the practice of dentistry in New Mexico. A | 0011| specialty license limits the licensee to practice only in that | 0012| specialty area. | 0013| G. The board may issue a specialty license by | 0014| credentials to an applicant who is duly licensed as a dentist | 0015| under the laws of another country if that person has at least | 0016| twenty-five years of practical experience in dentistry in the | 0017| other country, twenty of which are in the specialized area of | 0018| dentistry for which the applicant is seeking licensure. The | 0019| applicant shall meet the requirements set forth by rules and | 0020| regulations of the board, including paying the appropriate fees | 0021| and passing an examination covering the laws and regulations of | 0022| the practice of dentistry in New Mexico. A specialty license | 0023| limits the licensee to practice only in that specialty area." | 0024|  |
