ARAGON | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO A VACANCY IN THE OFFICE OF UNITED STATES SENATOR; | 0012| AMENDING A SECTION OF THE NMSA 1978 TO CHANGE THE MANNER OF | 0013| FILLING A VACANCY. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 1-15-14 NMSA 1978 (being Laws 1969, | 0017| Chapter 240, Section 364) is amended to read: | 0018| "1-15-14. UNITED STATES SENATOR--VACANCY.-- | 0019| A. Immediately upon there being a vacancy in the | 0020| office of United States senator, the [governor] New Mexico | 0021| senate, by simple resolution, shall make a temporary | 0022| appointment to fill the vacancy until such time as an election | 0023| is held to fill the vacancy for the unexpired term. In the | 0024| event the legislature is not in session and is not scheduled to | 0025| convene a session within thirty days of a vacancy, the governor | 0001| shall make a temporary appointment to fill the vacancy. The | 0002| governor's appointee shall serve until a successor is elected | 0003| or the legislative session convenes, whichever occurs first. | 0004| B. The election to fill the vacancy for the | 0005| unexpired term shall be held at the next general election | 0006| occurring not less than thirty days subsequent to the happening | 0007| of such vacancy. | 0008| C. If the vacancy occurs within thirty days next | 0009| preceding a general election, the person appointed [by the | 0010| governor] to fill the vacancy shall hold office until the next | 0011| general election occurring more than thirty days subsequent to | 0012| the happening of the vacancy unless the term of office of such | 0013| senator shall sooner expire. | 0014| D. Candidates to fill a vacancy in the office of | 0015| United States senator for an unexpired term shall be nominated | 0016| and elected in the same manner as candidates are nominated and | 0017| elected for the full term." | 0018|  |
