SANCHEZ | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO MUNICIPALITIES; CLARIFYING CERTAIN AUTHORITY OF THE | 0012| MAYOR IN A MAYOR-COUNCIL FORM OF MUNICIPAL GOVERNMENT. | 0013| | 0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0015| Section 1. Section 3-13-3 NMSA 1978 (being Laws 1965, | 0016| Chapter 300, Section 14-12-3, as amended) is amended to read: | 0017| "3-13-3. APPOINTMENT OF PROFESSIONAL ADMINISTRATOR-- | 0018| DUTIES AND QUALIFICATIONS.-- | 0019| A. The governing body of any municipality having a | 0020| population of one thousand or more persons may provide [for a | 0021| manager either by ordinance or by an election to be called by | 0022| the governing body upon the filing of a petition containing the | 0023| signatures of at least ten percent of the registered voters in | 0024| the municipality. The office of manager shall carry the same | 0025| qualifications, duties and responsibilities as provided for a | 0001| manager under Sections 3-14-13 through 3-14-15 NMSA 1978] by | 0002| ordinance for a professional administrator. The administrator | 0003| shall be supervised by the mayor. The administrator shall: | 0004| (1) enforce and carry out all ordinances, | 0005| rules and regulations enacted by the governing body; | 0006| (2) prepare and submit an annual budget; | 0007| (3) recommend to the mayor qualified persons | 0008| to be appointed as employees or officers of the municipality; | 0009| and | 0010| (4) make recommendations to the mayor and the | 0011| governing body on all matters concerning the welfare of the | 0012| municipality. | 0013| B. The administrator shall have a seat, but no | 0014| vote, at every meeting of the governing body. | 0015| C. The administrator shall be appointed by the | 0016| mayor with the approval of the governing body. | 0017| D. Unless reappointed, no administrator shall be | 0018| employed beyond the day of the organizational meeting required | 0019| in Section 3-11-5 NMSA 1978." | 0020|  |
