RODRIGUEZ | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO EDUCATION; AMENDING REQUIREMENTS FOR ADMISSION TO | 0012| STATE INSTITUTIONS FOR HOME SCHOOL OR NON-PUBLIC SCHOOL | 0013| STUDENTS; REQUIRING PUBLIC SCHOOLS TO ENROLL TRANSFERRING HOME | 0014| SCHOOL OR PRIVATE SCHOOL STUDENTS AT THE LEVEL APPROPRIATE TO | 0015| THEIR AGE AND TEST SCORES. | 0016| | 0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0018| Section 1. Section 21-1-1 NMSA 1978 (being Laws 1912, | 0019| Chapter 83, Section 2, as amended) is amended to read: | 0020| "21-1-1. [ID.] STATE INSTITUTIONS [SUPPORT AND | 0021| MAINTENANCE; STUDENTS--EXAMINATION] ADMISSION REQUIREMENTS TO | 0022| BE ESTABLISHED BY BOARDS OF REGENTS. [Sec. 145.] | 0023| A. The respective boards of regents of [the New | 0024| Mexico College of Agriculture and Mechanic Arts, the New Mexico | 0025| School of Mines] New Mexico state university, New Mexico | 0001| institute of mining and technology, the university of New | 0002| Mexico and the New Mexico military institute at Roswell shall | 0003| determine and fix the standard of requirements for admission to | 0004| their respective institutions. | 0005| B. In determining the standard of requirements for | 0006| admission to their respective institutions, boards of regents | 0007| shall not require a student who has completed the requirements | 0008| of a home-based or non-public school educational program, and | 0009| who has submitted test scores that otherwise qualify him for | 0010| admission to that institution, to obtain or submit proof of | 0011| having obtained a general education development certificate. | 0012| In determining requirements for admission, boards of regents | 0013| shall evaluate and treat applicants from home-based educational | 0014| programs or non-public schools fairly and in a | 0015| nondiscriminatory manner." | 0016| Section 2. Section 22-1-4 NMSA 1978 (being Laws 1975, | 0017| Chapter 338, Section 1, as amended) is amended to read: | 0018| "22-1-4. FREE PUBLIC SCHOOLS--EXCEPTIONS--WITHDRAWING AND | 0019| ENROLLING.-- | 0020| A. Except as provided by Section 24-5-2 NMSA 1978, | 0021| a free public school education shall be available to any | 0022| school-age person who is a resident of this state and has not | 0023| received a high school diploma or its equivalent. | 0024| B. A free public school education in those courses | 0025| already offered to persons under Subsection A of this section | 0001| shall be available to any person who is a resident of this | 0002| state and has received a high school diploma or its equivalent | 0003| if there is available space in such courses. | 0004| C. Any person entitled to a free public school | 0005| education under this section may enroll or re-enroll in a | 0006| public school at any time and, unless required to attend school | 0007| pursuant to the Compulsory School Attendance Law, may withdraw | 0008| from a public school at any time. | 0009| D. Local school boards shall promulgate regulations | 0010| concerning the enrollment and re-enrollment of all persons.
