0011|     RELATING TO LANDFILLS; SEPARATING THE DECISIONS REGARDING

0012|     ACCEPTABLE LAND USE FROM SCIENTIFIC VIABILITY OF A LANDFILL
    |

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  LOCAL GOVERNMENT DECISIONS REGARDING
    |
0017|     LANDFILLS.-- Local political subdivisions of the state who
    |
0018|     grant or deny requests for zone changes for landfills will
    |
0019|     grant or deny the requests in accordance with the state Open
    |
0020|     Meetings Act and after conducting public hearings on the
    |
0021|     application.  The granting or denying of a zone change
    |
0022|     application by the political subdivision will be based solely
    |
0023|     on the geographic location of the requested landfill and shall
    |
0024|     exclude from its decision the environmental and scientific
    |
0025|     merits of the location.  The granting of a zone change permit
    |
0001|     shall only be issued by the political subdivision upon the
    |
0002|     issuance of an operating permit from the environmental
    |
0003|     improvement division of the department of health.  Landfills
    |
0004|     zoned and permitted by the state prior to July 1, 1997, shall
    |
0005|     be excluded and may continue to operate as long as they remain
    |
0006|     in compliance with the requirements of the division and the
    |
0007|     local zoning conditions.
