0017| RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE;

0018| AMENDING AND REPEALING SECTIONS OF THE CAMPAIGN REPORTING ACT

0019| RELATED TO PERSONS IN A REGULATORY OFFICE AND THE SOLICITATION

0020| OF CAMPAIGN CONTRIBUTIONS.

0022| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0023| Section 1. Section 1-19-34.5 NMSA 1978 (being Laws 1995,
|
0024| Chapter 153, Section 18) is amended to read:
|
0025| "1-19-34.5. PRESUMPTIONS--CIVIL ACTION. [A.] For
|
0001| purposes of a civil action, it shall be presumed that a public
|
0002| official or a candidate for public office subject to the
|
0003| Campaign Reporting Act has authorized and approved each
|
0004| solicitation for campaign contributions made by his campaign
|
0005| committee or a person authorized by the candidate to solicit
|
0006| campaign contributions on his behalf.
|
0007| [B. For purposes of a civil action, it shall be
|
presumed that a candidate who seeks election to a regulatory
|
office, as described in Section 1-19-34.2 NMSA 1978, has
|
advised his campaign committee and all persons authorized by
|
the candidate to solicit campaign contributions on his behalf
|
that it is unlawful to solicit contributions from an entity or
|
its officers or employees or a person that is directly
|
regulated by the office the candidate seeks.]"

0015| Section 2. REPEAL.--Section 1-19-34.2 NMSA 1978 (being

0016| Laws 1993, Chapter 46, Section 13, as amended) is repealed.
