0010|                           A JOINT MEMORIAL
    |
0011|     REQUESTING THE CONSTRUCTION INDUSTRIES DIVISION OF THE
    |
0012|     REGULATION AND LICENSING DEPARTMENT IN COOPERATION WITH LOCAL
    |
0013|     GOVERNMENTS TO PREPARE CHANGES TO THE BUILDING CODES OF THE
    |
0014|     STATE TO PROTECT DARK SKIES.
    |

    |
0016|          WHEREAS, more than two hundred million dollars
    |
0017|     ($200,000,000) has already been invested in New Mexico for
    |
0018|     astronomical observatories; and
    |
0019|          WHEREAS, astronomy represents a potential clean industry
    |
0020|     to the state; and
    |
0021|          WHEREAS, New Mexico's viability as an international center
    |
0022|     for astronomical research depends on dark skies, which are
    |
0023|     being threatened by light pollution; and
    |
0024|          WHEREAS, the excessive use of light wastes energy,
    |
0025|     increases consumer costs, diminishes public appreciation of
    |
0001|     scenic vistas and interferes with the public's right to
    |
0002|     privacy; and
    |
0003|          WHEREAS, exterior lighting technology is available that
    |
0004|     provides better personal security, more efficient energy use,
    |
0005|     less invasion of personal privacy and improved night time
    |
0006|     aesthetics; and
    |
0007|          WHEREAS, careful use of outdoor lighting with shielded or
    |
0008|     redirected lights and low-pressure sodium light bulbs is energy
    |
0009|     efficient and can enhance public safety without harming dark
    |
0010|     sky resources; and 
    |
0011|          WHEREAS, Alamogordo, Cloudcroft and Tucson have already
    |
0012|     enacted ordinances to require more sensitive exterior lighting
    |
0013|     to the benefit of their local astronomy industries;
    |
0014|          NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0015|     STATE OF NEW MEXICO that the construction industries division
    |
0016|     of the regulation and licensing department, with the
    |
0017|     cooperation of local governments, be requested to develop
    |
0018|     changes to the building codes that require exterior lighting
    |
0019|     technologies and design to protect New Mexico's dark skies
    |
0020|     resources; and
    |
0021|          BE IT FURTHER RESOLVED that copies of this memorial be
    |
0022|     sent to the director of the construction industries division.
