0011|     REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO ASSIGN A
    |
0012|     REVIEW AND REVISION OF THE PAWNBROKERS ACT TO AN APPROPRIATE
    |
0013|     INTERIM COMMITTEE.

0015|          WHEREAS, the Pawnbrokers Act was enacted in 1985; and
    |
0016|          WHEREAS, a great deal of confusion exists because of
    |
0017|     conflicts between the Uniform Commercial Code and the wording
    |
0018|     of the Pawnbrokers Act; and
    |
0019|          WHEREAS, there are several areas of regulation that are
    |
0020|     not covered by the provisions of the Pawnbrokers Act; and
    |
0021|          WHEREAS, representatives of the pawnbrokers in the state
    |
0022|     attended hearings during the 1995 legislative session and
    |
0023|     agreed to work with the legislature to revise the Pawnbrokers
    |
0024|     Act; and
    |
0025|          WHEREAS, investigation and enforcement pursuant to
    |
0001|     provisions of the Pawnbrokers Act are weak and ineffectual;
    |
0002|          NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0003|     STATE OF NEW MEXICO that the New Mexico legislative council
    |
0004|     assign the review and revision of the Pawnbrokers Act to an
    |
0005|     appropriate interim legislative committee; and
    |
0006|          BE IT FURTHER RESOLVED that the interim committee assigned
    |
0007|     to review the Pawnbrokers Act shall report on the progress of
    |
0008|     its review to the second session of the forty-third legislature
    |
0009|     and make final recommendations and present proposed legislation
    |
0010|     to the first session of the forty-fourth legislature; and
    |
0011|          BE IT FURTHER RESOLVED that the legislature instruct the
    |
0012|     committee to look closely at the practices surrounding pawning
    |
0013|     of vehicles, especially in the northwest quadrant of the state,
    |
0014|     and prepare appropriate legislation to correct shortcomings of
    |
0015|     the Pawnbrokers Act; and
    |
0016|          BE IT FURTHER RESOLVED that copies of this memorial be
    |
0017|     distributed to the members of the New Mexico legislative
    |
0018|     council.

0017|             1.  On page 2, between lines 9 and 10, insert:

0019|        "BE IT FURTHER RESOLVED that the New Mexico legislative
    |
0020|   council instruct the committee to propose legislation that would
    |
0021|   bring the Pawnbrokers Act into compliance with federal law and
    |
0022|   seek industry involvement in rewriting the provisions of that
    |
0023|   act; and".

0025|        2.  On page 2, line 10, strike "legislature" and insert in
    |
0001|   lieu thereof "legislative council".,
    |

0003|   and thence referred to the JUDICIARY COMMITTEE.
