0011|     REQUESTING THAT THE FEDERAL ENVIRONMENTAL PROTECTION AGENCY
    |
0012|     RETAIN EXISTING OZONE AND PARTICULATE AIR EMISSION STANDARDS.

    |
0014|          WHEREAS, the federal environmental protection agency has a
    |
0015|     responsibility to periodically review the national ambient air
    |
0016|     quality standards for ozone and particulate matter; and
    |
0017|          WHEREAS, the environmental protection agency is
    |
0018|     considering establishing a more stringent ozone standard and a
    |
0019|     new, more stringent standard for particulate matter at or below
    |
0020|     two and one-half microns; and
    |
0021|          WHEREAS, New Mexico and its local jurisdictions,
    |
0022|     businesses and citizens have supported health-based national
    |
0023|     ambient air quality standards that are premised on sound
    |
0024|     science; and
    |
0025|          WHEREAS, New Mexico has made progress in meeting current
    |
0001|     national ambient air quality standards for both ozone and
    |
0002|     particulate matter under the Clean Air Act amendments of 1990,
    |
0003|     although there are some areas that have not yet come into
    |
0004|     attainment with the current standards due to air pollutants
    |
0005|     from outside New Mexico; and
    |
0006|          WHEREAS, the proposed new standards may significantly
    |
0007|     expand the number of nonattainment areas for both ozone and
    |
0008|     particulate matter, resulting in additional emission controls
    |
0009|     in all areas, thus possibly imposing significant economic,
    |
0010|     administrative and regulatory burdens on New Mexico and its
    |
0011|     citizens, businesses and local governments; and
    |
0012|          WHEREAS, the environmental protection agency's own clean
    |
0013|     air science advisory committee was unable to find any "bright
    |
0014|     line" that would distinguish any public health benefit among
    |
0015|     any of the proposed new standards for ozone, including the
    |
0016|     current standard; and
    |
0017|          WHEREAS, there is very little existing particulate matter
    |
0018|     monitoring data; and
    |
0019|          WHEREAS, there are many unanswered questions and
    |
0020|     scientific uncertainties regarding the health effects of
    |
0021|     particulate matter, including:
    |
0022|               A.  divergent opinions among scientists who have
    |
0023|     investigated the issue;
    |
0024|               B.  exposure misclassification;
    |
0025|               C.  measurement errors;
    |
0001|               D.  the lack of supporting toxicological data;
    |
0002|               E.  the lack of a plausible toxicological mechanism;
    |
0003|               F.  the lack of correlation between recorded
    |
0004|     particulate matter levels and public health effects;
    |
0005|               G.  the influence of other variables; and
    |
0006|               H.  the existence of possible alternative
    |
0007|     explanations; and
    |
0008|          WHEREAS, establishing a more stringent ozone standard or a
    |
0009|     new, more stringent particulate matter standard would assuredly
    |
0010|     impose significantly higher costs;
    |
0011|          NOW, THEREFORE, BE IT RESOLVED, BY THE LEGISLATURE OF THE
    |
0012|     STATE OF NEW MEXICO that the environmental protection agency
    |
0013|     reaffirm the existing standards for ozone and particulate
    |
0014|     matter; and 
    |
0015|          BE IT FURTHER RESOLVED that the environmental protection
    |
0016|     agency be requested to gather the necessary particulate matter
    |
0017|     monitoring data and conduct all necessary research needed to
    |
0018|     address the issue of causality and other critical and important
    |
0019|     unanswered scientific questions concerning particulates in the
    |
0020|     air; and
    |
0021|          BE IT FURTHER RESOLVED that the environmental protection
    |
0022|     agency be requested to identity any unfunded mandates or other
    |
0023|     administrative and economic burdens for the state or local
    |
0024|     governments or agencies that would result from the proposed
    |
0025|     changes to the national ambient air quality standards for ozone
    |
0001|     and particulate matter; and
    |
0002|          BE IT FURTHER RESOLVED that copies of this memorial be
    |
0003|     transmitted to the president of the United States, the
    |
0004|     president of the United States senate, the speaker of the
    |
0005|     United States house of representatives, the New Mexico
    |
0006|     congressional delegation and the administrator of the
    |
0007|     environmental protection agency.
