0001| HOUSE JOINT MEMORIAL 82 | 0002| 43rd legislature - STATE OF NEW MEXICO - first session, 1997 | 0003| INTRODUCED BY | 0004| JAMES ROGER MADALENA | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| A JOINT MEMORIAL | 0011| REQUESTING THE UNITED STATES DEPARTMENT OF EDUCATION TO STUDY | 0012| THE REQUIREMENTS FOR CHARTER SCHOOLS PURSUANT TO THE IMPROVING | 0013| AMERICA'S SCHOOLS ACT OF 1994 AND REQUESTING THE STATE BOARD OF | 0014| EDUCATION TO STUDY ACCREDITATION OPTIONS AVAILABLE TO BUREAU OF | 0015| INDIAN AFFAIRS FUNDED SCHOOLS SEEKING STATE BOARD OF EDUCATION | 0016| ACCREDITATION SO THAT THOSE SCHOOLS HAVE ALL THE FLEXIBILITY | 0017| GRANTED STATE CHARTER SCHOOLS. | 0018| | 0019| WHEREAS, on April 6, 1993, Governor Bruce King signed the | 0020| Charter Schools Act into law, joining Minnesota and California, | 0021| which had already enacted legislation to establish charter | 0022| schools, and since that time over twenty-five additional states | 0023| have enacted similar legislation; and | 0024| WHEREAS, the benefits to becoming a charter school include | 0025| implementing alternative curricula, creating and using | 0001| alternative methods of assessment, increased parent and | 0002| community involvement and support and flexibility in the areas | 0003| of class size and structure; and | 0004| WHEREAS, bureau of Indian affairs funded schools should | 0005| enjoy the benefits of restructuring their educational | 0006| curriculum to encourage the use of different and innovative | 0007| teaching methods to address student needs; and | 0008| WHEREAS, implementing alternative curricula, creating and | 0009| using alternative methods of assessment, increased parent and | 0010| community involvement and support and flexibility in the areas | 0011| of class size and structure should not operate so as to | 0012| compromise or impede the accreditation status of bureau of | 0013| Indian affairs funded schools; and | 0014| WHEREAS, participation in funding made available to public | 0015| funded charter schools under the Improving America's Schools | 0016| Act of 1994 is limited to schools operated under public | 0017| supervision and direction; and | 0018| WHEREAS, bureau of Indian affairs schools are not eligible | 0019| for such funding; | 0020| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0021| STATE OF NEW MEXICO that the United States department of | 0022| education be requested to study requirements for charter | 0023| schools under the Improving America's Schools Act of 1994 to | 0024| include bureau of Indian affairs funded schools; and | 0025| BE IT FURTHER RESOLVED that the state board of education | 0001| study accreditation options available to bureau of Indian | 0002| affairs schools seeking state board of education accreditation | 0003| so that those schools have all the flexibility granted state | 0004| charter schools; and | 0005| BE IT FURTHER RESOLVED that a copy of this memorial be | 0006| transmitted to the superintendent of public instruction, to the | 0007| assistant secretary of the department of the interior and to | 0008| the secretary of the United States department of education. | 0009|  State of New Mexico | 0010| House of Representatives | 0011| | 0012| FORTY-THIRD LEGISLATURE | 0013| FIRST SESSION, 1997 | 0014| | 0015| | 0016| March 12, 1997 | 0017| | 0018| | 0019| Mr. Speaker: | 0020| | 0021| Your EDUCATION COMMITTEE, to whom has been referred | 0022| | 0023| HOUSE JOINT MEMORIAL 82 | 0024| | 0025| has had it under consideration and reports same with | 0001| recommendation that it DO PASS. | 0002| | 0003| Respectfully submitted, | 0004| | 0005| | 0006| | 0007| | 0008| | 0009| Samuel F.
