0011|     REQUESTING THE HOUSE OF REPRESENTATIVES LEADERSHIP TO ESTABLISH
    |
0012|     A SUBCOMMITTEE OF THE HOUSE TO REVIEW THE LEVEL OF SERVICES
    |
0013|     PROVIDED BY THE CHILDREN, YOUTH AND FAMILIES DEPARTMENT TO THE
    |
0014|     ADULT COMMUNITY IN NEED OF PROTECTIVE SERVICES AND TO OVERSEE
    |
0015|     THE MANNER IN WHICH ADULT PROTECTIVE SERVICES ARE PROVIDED.
    |

    |
0017|          WHEREAS, in 1989 the legislature recognized that some
    |
0018|     members of the adult population of the state were in need of
    |
0019|     services because they were unable to manage their own affairs
    |
0020|     or to protect themselves from exploitation, abuse or neglect;
    |
0021|     and
    |
0022|          WHEREAS, the Adult Protective Services Act was enacted to
    |
0023|     address the problems recognized by the legislature; and
    |
0024|          WHEREAS, the adult protective services program was moved
    |
0025|     administratively to the children, youth and families department
    |
0001|     in the early 1990s from the human services department; and
    |
0002|          WHEREAS, since that time the program has had twelve staff
    |
0003|     positions reassigned to perform duties not related to providing
    |
0004|     adult protective services; and 
    |
0005|          WHEREAS, providing adult protective services is evidently
    |
0006|     not a priority within the children, youth and families
    |
0007|     department;
    |
0008|          NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
    |
0009|     REPRESENTATIVES OF THE STATE OF NEW MEXICO that a subcommittee
    |
0010|     of the house of representatives be appointed by the house
    |
0011|     leadership to review and assess the implementation of the Adult
    |
0012|     Protective Services Act; and
    |
0013|          BE IT FURTHER RESOLVED that the subcommittee be charged
    |
0014|     with reviewing the attendant care program and the adequacy of
    |
0015|     training received by the adult protective services workers;
    |
0016|     determining if the adult abuse prevention unit should be moved
    |
0017|     to the protective services division of the children, youth and
    |
0018|     families department; and assessing the progress of the
    |
0019|     children, youth and families department in improving facility
    |
0020|     investigations to ensure accurate and timely reporting of
    |
0021|     client exploitation, abuse and neglect at facilities in the
    |
0022|     state, the need for guardians for incapacitated adults and for
    |
0023|     cooperative efforts between and the adequacy of staffing of the
    |
0024|     department of health, the state agency on aging and the
    |
0025|     protective services division as those agencies provide services
    |
0001|     to adults and developmentally disabled individuals who are in
    |
0002|     need of protective services; and
    |
0003|          BE IT FURTHER RESOLVED that the subcommittee identify
    |
0004|     issues regarding the provision of protective services to adults
    |
0005|     that can be resolved by legislation and develop the necessary
    |
0006|     legislation to resolve those issues; and
    |
0007|          BE IT FURTHER RESOLVED that the subcommittee report at
    |
0008|     each future session of the legislature on its progress and the
    |
0009|     need to continue in its work; and 
    |
0010|          BE IT FURTHER RESOLVED that copies of this memorial be
    |
0011|     transmitted to the leadership of the house of representatives
    |
0012|     for their consideration and action.
