0011|     REQUESTING THE LAS CAMPANAS SUBDIVISION TO HONOR ITS COMMITMENT
    |
0012|     TO DONATE A RIGHT OF WAY FOR THE SANTA FE RELIEF ROUTE.

0014|          WHEREAS, the population of the Santa Fe area has grown by
    |
0015|     over thirty thousand since 1980; and
    |
0016|          WHEREAS, highway infrastructure, especially on the north-
    |
0017|     south corridors, is inadequate to accommodate the increased
    |
0018|     traffic; and
    |
0019|          WHEREAS, subdivisions such as Las Campanas have
    |
0020|     contributed to growth in population, higher taxes, higher costs
    |
0021|     of living and to the traffic congestion; and
    |
0022|          WHEREAS, subdivisions such as Las Campanas do not pay all
    |
0023|     the costs for community infrastructure that they incur; and
    |
0024|          WHEREAS, the Santa Fe relief route is desperately needed
    |
0025|     to relieve congestion on U.S. highway 285; and
    |
0001|          WHEREAS, Las Campanas will benefit directly from the
    |
0002|     completion of the Santa Fe relief route; and
    |
0003|          WHEREAS, the city of Santa Fe and the state highway and
    |
0004|     transportation department designed the relief route with the
    |
0005|     owners and representatives of Las Campanas amending it many
    |
0006|     times over the ten-year design period to meet the needs of Las
    |
0007|     Campanas; and
    |
0008|          WHEREAS, in recognition of the benefits to itself of the
    |
0009|     Santa Fe relief route, Las Campanas had agreed to donate eighty
    |
0010|     acres for the right of way of the relief route; and
    |
0011|          WHEREAS, condemnation of right of way would cost the state
    |
0012|     at least one million five hundred thousand dollars ($1,500,000)
    |
0013|     and would adversely affect relations between Las Campanas and
    |
0014|     local and state governments, would further delay the
    |
0015|     development of Las Campanas and would possibly slow population
    |
0016|     growth, development and economic expansion in the Santa Fe
    |
0017|     region; and
    |
0018|          WHEREAS, Las Campanas has reneged on its commitments to
    |
0019|     make the right-of-way donation pending approvals of land-use
    |
0020|     plans of Las Campanas by the city and county; and
    |
0021|          WHEREAS, local approval of land-use plans by law proceeds
    |
0022|     according to local government land-use policy and procedure,
    |
0023|     not according to the specific demands of individual developers
    |
0024|     or other interest groups; 
    |
0025|          NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
    |
0001|     REPRESENTATIVES OF THE STATE OF NEW MEXICO that Las Campanas be
    |
0002|     requested to complete the donation to the state of eighty acres
    |
0003|     of right of way it has promised and not attempt to exact a quid
    |
0004|     pro quo from the city and county relative to lawful subdivision
    |
0005|     and land-use approval procedures; and
    |
0006|          BE IT FURTHER RESOLVED that Las Campanas present its plans
    |
0007|     for transportation, water, utility and service infrastructure,
    |
0008|     land-use development and community relations to the appropriate
    |
0009|     interim committee of the legislature by August 1, 1997; and
    |
0010|          BE IT FURTHER RESOLVED that copies of this memorial be
    |
0011|     transmitted to the secretary of highway and transportation, the
    |
0012|     state engineer, the director of the local government division
    |
0013|     of the department of finance and administration, the secretary
    |
0014|     of economic development, the governor, the mayor and city
    |
0015|     council of Santa Fe, the Santa Fe county commission and to Las
    |
0016|     Campanas.
