0011|     REQUESTING THE UNITED STATES CONGRESS TO INCREASE THE FUNDING
    |
0012|     LEVEL FOR THE INDIAN ROADS CONSTRUCTION FUND TO THREE HUNDRED
    |
0013|     MILLION DOLLARS ($300,000,000) PER YEAR.

0015|          WHEREAS, through various treaties and acts of congress,
    |
0016|     the federal government has promised Indian tribes certain goods
    |
0017|     and services, one of which is transportation services, to serve
    |
0018|     the social and economic needs of Indian tribes; and
    |
0019|          WHEREAS, Indian tribes are totally dependent on the
    |
0020|     federal transportation programs for their transportation needs
    |
0021|     due to the fact that under federal law Indian tribes are not
    |
0022|     eligible to administer federal highway trust funds directly or
    |
0023|     eligible to receive a portion of fuel tax revenue collected on
    |
0024|     Indian reservations for transportation purposes; and
    |
0025|          WHEREAS, there is a critical need to improve
    |
0001|     transportation services on the Indian reservations throughout
    |
0002|     the United States to promote economic development, improve
    |
0003|     health care, enhance education and increase employment; and
    |
0004|          WHEREAS, the Indian tribes and pueblos recognize and
    |
0005|     appreciate the support the transportation programs have
    |
0006|     contributed to the success of many social and economic
    |
0007|     development efforts on all Indian reservations; and
    |
0008|          WHEREAS, pursuant to the Surface Transportation Assistance
    |
0009|     Act of 1982, the United States secretary of transportation is
    |
0010|     to allocate funds authorized to be appropriated for Indian
    |
0011|     reservation roads in accordance with the "relative needs" of
    |
0012|     the various Indian reservations;
    |
0013|          NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0014|     STATE OF NEW MEXICO that the United States congress be
    |
0015|     requested to increase the funding level of the Indian roads
    |
0016|     construction fund to three hundred million dollars
    |
0017|     ($300,000,000) per year; and
    |
0018|          BE IT FURTHER RESOLVED that because of the importance of
    |
0019|     increasing the funding level of Indian roads construction funds
    |
0020|     the legislature request that the bureau of Indian affairs
    |
0021|     implement immediately the relative needs distribution formula;
    |
0022|     and
    |
0023|          BE IT FURTHER RESOLVED that copies of this memorial be
    |
0024|     transmitted to the New Mexico congressional delegation, the
    |
0025|     United States secretary of the interior, the United States
    |
0001|     secretary of transportation and the Navajo nation.
