0011|     REQUESTING THE ALBUQUERQUE METROPOLITAN ARROYO FLOOD CONTROL

0012|     AUTHORITY TO CREATE JOINT POWERS AGREEMENTS TO PROVIDE DRAINAGE
    |
0013|     BENEFITS TO VALLEY RESIDENTS, AND TO FUND THE APPROPRIATE
    |
0014|     AGENCY FOR FLOOD CONTROL AND DRAINAGE WORK IN PROPORTION TO
    |
0015|     REVENUE COLLECTED FROM VALLEY RESIDENTS.
    |

0017|          WHEREAS, the New Mexico legislature established the
    |
0018|     Albuquerque metropolitan arroyo flood control authority to deal
    |
0019|     with flood control issues in the greater Albuquerque
    |
0020|     metropolitan area; and
    |
0021|          WHEREAS, the authority has focused its capital
    |
0022|     construction program on controlling arroyo flooding, which
    |
0023|     affected valley residents; and
    |
0024|          WHEREAS, multimillion-dollar projects have been developed
    |
0025|     in this area to control flooding from arroyos but not within
    |
0001|     the north and south valleys; and
    |
0002|          WHEREAS, the authority has done drainage master planning
    |
0003|     for the south valley, but has not yet implemented a
    |
0004|     construction program; and
    |
0005|          WHEREAS, flooding and ponding of rainwater within the
    |
0006|     valley constitutes disaster status in many parts of the valley;
    |
0007|     and
    |
0008|          WHEREAS, residents in the valley area pay an annual
    |
0009|     property tax assessment to many local governments for flood
    |
0010|     control and drainage; and
    |
0011|          WHEREAS, valley residents deserve to have local drainage
    |
0012|     problems addressed as soon as possible; 
    |
0013|          NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE
    |
0014|     OF NEW MEXICO that the Albuquerque metropolitan arroyo flood
    |
0015|     control authority, the city of Albuquerque, the middle Rio
    |
0016|     Grande conservancy district and Bernalillo county develop joint
    |
0017|     powers agreements for the planning, design, construction and
    |
0018|     maintenance of flood control and drainage projects in the north
    |
0019|     and south valleys, with the objective that the authority will
    |
0020|     commit funding for the benefit of the valley area in proportion
    |
0021|     to the revenue it collects from the valley; and
    |
0022|          BE IT FURTHER RESOLVED that the authority report on the
    |
0023|     status of the recommended joint powers efforts to the second
    |
0024|     session of the forty-third legislature; and
    |
0025|          BE IT FURTHER RESOLVED that copies of this memorial be
    |
0001|     transmitted to the Albuquerque metropolitan arroyo flood
    |
0002|     control authority, the city of Albuquerque, the middle Rio
    |
0003|     Grande conservancy district and Bernalillo county.
