0011|     PROPOSING TO SELL LA VILLA RIVERA, MARIAN HALL AND CATHEDRAL

0012|     PARK IN SANTA FE IN SANTA FE COUNTY.

0014|          WHEREAS, Section 13-6-3 NMSA 1978 requires ratification
    |
0015|     and approval of any sale of real property by a state agency for
    |
0016|     a consideration of one hundred thousand dollars ($100,000) or
    |
0017|     more; and
    |
0018|          WHEREAS, the property control division of the general
    |
0019|     services department is desirous of selling real property and
    |
0020|     improvements, legal description set forth below; and
    |
0021|          WHEREAS, the property control division proposes to sell La
    |
0022|     Villa Rivera, Marian hall and Cathedral park in Santa Fe
    |
0023|     county, New Mexico and more particularly described as:
    |
0024|               Beginning at a point marked by a 1/2" rebar on the
    |
0025|          southerly side of East Palace Avenue, whence the
    |
0001|          center of manhole cover No. W3-16 at the
    |
0002|          intersection of Cathedral Place and East Palace
    |
0003|          Avenue bears N. 59  42' W., 56.44 feet; thence, from
    |
0004|          said point of beginning, along the southerly side of
    |
0005|          East Palace Avenue S. 73  36' E., 799.25 feet to a
    |
0006|          point marked by an "X" mark on sidewalk, whence the
    |
0007|          center of manhole cover No. W3-21 at the
    |
0008|          intersection of East Palace Avenue and South
    |
0009|          Castillo Avenue bears N. 72  39' E., 62.21 feet;

0010|          thence on a curve to the right,    R = 24.70 feet,

0011|          through an arc length of 34.37 feet to a point

0025|          chord of the said arc running N. 66  59' E., 28.52

0001|          feet; all as shown on that certain plat of survey
    |
0002|          entitled "PLAT OF SURVEY FOR SISTERS OF CHARITY ST.

0003|          VINCENT'S HOSPITAL WARD NO. 4 SANTA FE, NEW MEXICO",

0004|          prepared from a survey completed in the field on
    |
0005|          October 12, 1973 by George Rivera, Registered
    |
0006|          Professional Land Surveyor No. 3149;      TOGETHER
    |
0007|          WITH all buildings, improvements and fixtures
    |
0008|          located thereon or appurtenant thereto;
    |
0009|                    WITH WARRANTY COVENANTS.
    |
0010|                    By acceptance of this deed, the grantee
    |
0011|          covenants and agrees that the above-described
    |
0012|          property shall not, at any time prior to October 1,
    |
0013|          2001, be used for a use which is competitive with
    |
0014|          the grantor's use of the facility known as "St.
    |
0015|          Vincent Hospital" on St. Michaels' Drive in Santa
    |
0016|          Fe, New Mexico, as an acute care hospital.; and
    |
0017|          WHEREAS, the property shall not be sold for less than the
    |
0018|     value of the property established by the taxation and revenue
    |
0019|     department using generally acceptable appraisal techniques for
    |
0020|     this type of property;
    |
0021|          NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0022|     STATE OF NEW MEXICO that the proposed sale be hereby ratified
    |
0023|     and approved pursuant to the provisions of Section 13-6-3 NMSA
    |
0024|     1978; and
    |
0025|          BE IT FURTHER RESOLVED that a copy of this resolution be
    |
0001|     transmitted to the property control division of the general
    |
0002|     services department.
