0011| PROPOSING TO AMEND ARTICLE 4 OF THE CONSTITUTION OF NEW MEXICO

0012| BY ADDING A NEW SECTION 43 TO AUTHORIZE AN INITIATIVE PROCESS

0013| FOR STATE LAWS OR CONSTITUTIONAL AMENDMENTS.

0015| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. It is proposed to amend Article 4 of the
|
0017| constitution of New Mexico by adding a new Section 43 to read:
|
0018| "A. The people reserve the power of initiative to
|
0019| amend the constitution and laws of the state.
|
0020| B. The initiative is the power of the people to
|
0021| propose amendments to the constitution and laws of New Mexico
|
0022| and to adopt or reject them. A constitutional amendment
|
0023| proposed by initiative shall require a petition signed by not
|
0024| less than ten percent of the registered qualified electors of
|
0025| the state, and a statutory amendment proposed by initiative
|
0001| shall require a petition signed by not less than five percent
|
0002| of the registered qualified electors of the state. The
|
0003| petition containing the text of the proposed amendment and the
|
0004| names and addresses of its sponsors shall be filed with the
|
0005| secretary of state at least four months prior to the next
|
0006| general election. The question of whether to approve or reject
|
0007| the amendment shall be submitted to the voters by the secretary
|
0008| of state at the next general election or at any special
|
0009| statewide election called for that purpose and held prior to
|
0010| the general election. An initiative approved by a majority of
|
0011| voters voting on the question shall take effect the day after
|
0012| certification of the election results by the state canvassing
|
0013| board, unless the amendment provides for a later effective
|
0014| date. No initiative shall direct appropriations, create public
|
0015| debt, provide for local or special laws or embrace more than
|
0016| one subject."
|
0017| Section 2. The amendment proposed by this resolution
|
0018| shall be submitted to the people for their approval or
|
0019| rejection at the next general election or at any special
|
0020| election prior to that date which may be called for that
|
0021| purpose.
