A new section of the Public School Code is | 0017| enacted to read: | 0018| "[NEW MATERIAL] SHORT TITLE.--This act may be cited as | 0019| the "Career Education Opportunities in Work Force Development | 0020| Act"." | 0021| Section 2. A new section of the Public School Code is | 0022| enacted to read: | 0023| "[NEW MATERIAL] FINDINGS--PURPOSE OF ACT.-- | 0024| A. The legislature finds that: | 0025| (1) a comprehensive and coherent system for |

0001| career education opportunities is necessary to help New Mexico | 0002| youth acquire the knowledge, skills, abilities and information | 0003| about, and access to, the labor market necessary to make an | 0004| effective transition from school to advanced job training, | 0005| post-secondary education and careers of choice; | 0006| (2) planned work experience that is linked to | 0007| academic learning can be very effective in engaging student | 0008| interest, enhancing skill acquisition, developing positive | 0009| work attitudes and preparing youth for high-skill, high-wage | 0010| careers; and | 0011| (3) students in New Mexico can achieve high | 0012| academic and career standards and achieve greater school | 0013| success through contextual learning that integrates applied | 0014| academics and workplace competencies into the core curriculum. | 0015| B. The purpose of the Career Education | 0016| Opportunities in Work Force Development Act is to require the | 0017| implementation of career education opportunities for work | 0018| force development in public schools and to establish career | 0019| education requirements that include: | 0020| (1) student mastery of the career readiness | 0021| standards benchmarks; | 0022| (2) a comprehensive career guidance program | 0023| that includes career awareness, career exploration, career | 0024| assessment and career planning activities that expose all | 0025| students to a broad array of career opportunities and that |

0001| facilitate the selection and pursuit of career choices based | 0002| on individual interests, goals, strengths and abilities; | 0003| (3) articulation between academic and | 0004| vocational skills through curriculum integration, tech prep, | 0005| concurrent enrollment, career academies and other recognized | 0006| approaches that combine a common core of learning and technical | 0007| education built on a foundation of basic proficiency in math, | 0008| science, communications and technology; | 0009| (4) structured work experience opportunities | 0010| for students that involve direct and indirect linkages between | 0011| the school and the workplace through which students develop | 0012| essential workplace competencies; | 0013| (5) implementation of promising programs such | 0014| as tech prep education, career academies, apprenticeships, | 0015| cooperative education, school-sponsored enterprises, business- | 0016| education compacts, vocational education and promising strategies | 0017| that assist students' transition from school to post-secondary | 0018| education, advanced training or employment; and | 0019| (6) local partnerships among secondary schools | 0020| and post-secondary educational institutions, private and public | 0021| employers, labor organizations, government, community-based | 0022| organizations, parents, students and state and local agencies to | 0023| link career education activities to future careers." | 0024| Section 3. A new section of the Public School Code is | 0025| enacted to read: |

0001| "[NEW MATERIAL] DEFINITIONS.--As used in the Career | 0002| Education Opportunities in Work Force Development Act: | 0003| A. "council" means the career education coordinating | 0004| council; | 0005| B. "department" means the department of education; | 0006| and | 0007| C. "division" means the vocational education division | 0008| of the department." | 0009| Section 4. A new section of the Public School Code is | 0010| enacted to read: | 0011| "[NEW MATERIAL] DIVISION DUTIES.--The division shall: | 0012| A. work with the council to administer and implement | 0013| the provisions of the Career Education Opportunities in Work | 0014| Force Development Act; | 0015| B. cooperate with other agencies to coordinate the | 0016| delivery of programs and services of career education | 0017| opportunities and work force development; | 0018| C. coordinate statewide training activities that | 0019| support career education for work force development; | 0020| D. assist public schools in the development and | 0021| implementation of effective career education opportunities for | 0022| all students, including students with disabilities and students | 0023| who are at risk of dropping out; | 0024| E. coordinate the development of a state plan that | 0025| ensures effective and efficient use of state and federal |

0001| resources to support the delivery of career education to New | 0002| Mexico students in collaboration with representatives of public | 0003| and post-secondary education, business, industry, government | 0004| agencies and other individuals involved in career education; and | 0005| F. collect data to evaluate the effectiveness of the | 0006| career education opportunities programs based on student | 0007| performance and program success indicators and report annually | 0008| the findings and recommendations to the council and the state | 0009| board." | 0010| Section 5. A new section of the Public School Code is | 0011| enacted to read: | 0012| "[NEW MATERIAL] CAREER EDUCATION COORDINATING COUNCIL-- | 0013| CREATION--APPOINTMENT--MEMBERSHIP.-- | 0014| A. The "career education coordinating council" is | 0015| created as an advisory to the executive, including the state | 0016| board, the commission on higher education and the legislature. | 0017| The council shall be appointed at the termination of the federal | 0018| school-to-work implementation grant or on July 1, 2001, whichever | 0019| is earlier, and shall be composed of fifteen members representing | 0020| different geographical areas of the state and reflecting the | 0021| diverse population of the state. | 0022| B. The president pro tempore of the senate shall | 0023| appoint two members from the senate, one from each of the two | 0024| major political parties, for terms of two years or less to | 0025| coincide with their terms of office. |

0001| C. The speaker of the house shall appoint two members | 0002| from the house of representatives, one from each of the two major | 0003| political parties, for terms of two years or less to coincide | 0004| with their terms of office. | 0005| D. The president of the state board shall appoint a | 0006| representative of the state board to a four-year term or until | 0007| his term of office expires. | 0008| E. The governor shall appoint a representative from | 0009| the governor's office to serve a four-year term. | 0010| F. Nine members shall be appointed jointly by the | 0011| governor, the speaker of the house of representatives, the | 0012| president pro tempore of the senate and the president of the | 0013| state board as follows: | 0014| (1) one representative of the division for a | 0015| four-year term; | 0016| (2) one representative of the job training | 0017| division of the labor department for a four-year term; | 0018| (3) one representative of the vocational | 0019| rehabilitation division of the department for a four-year term; | 0020| (4) one representative of a two-year post- | 0021| secondary educational institution for a four-year term; | 0022| (5) one representative of organized labor for a | 0023| four-year term; | 0024| (6) two representatives of the private sector | 0025| for four-year terms; and |

0001| (7) two representatives from public schools, to | 0002| include an administrator and a teacher, for four-year terms." | 0003| Section 6. A new section of the Public School Code is | 0004| enacted to read: | 0005| "[NEW MATERIAL] COUNCIL--PURPOSE AND DUTIES.--The council | 0006| shall: | 0007| A. review and approve the annual plan of the | 0008| department that pertains to employment training, employment | 0009| related education and work experience opportunities that affect | 0010| public school students; | 0011| B. coordinate any activities of other state agencies | 0012| that pertain to employment training, employment related education | 0013| and work experience opportunities that affect public school | 0014| students; | 0015| C. review and approve the department's state | 0016| strategic plan that ensures effective and efficient use of state | 0017| and federal resources to support the effective delivery of career | 0018| education to New Mexico students; | 0019| D. advise the department and the state board on the | 0020| implementation of the provisions of the Career Education | 0021| Opportunities in Work Force Development Act; | 0022| E. make recommendations to the state board, the | 0023| legislative education study committee, the legislative finance | 0024| committee and the executive on the coordination of federal and | 0025| state work force education funds and career education |

0001| opportunities for New Mexico students; and | 0002| F. develop a method of evaluating the effectiveness | 0003| of the state career education opportunities system." | 0004| Section 7. A new section of the Public School Code is | 0005| enacted to read: | 0006| "[NEW MATERIAL] STAFFING.--In order to carry out its | 0007| function, the council may: | 0008| A. use department funds available for state councils | 0009| under applicable career education related programs; and | 0010| B. be staffed by division employees." | 0011| Section 8. A new section of the Public School Code is | 0012| enacted to read: | 0013| "[NEW MATERIAL] ANNUAL REPORTS.--The department shall submit | 0014| annually to the legislative education study committee a report | 0015| regarding the status of career education in New Mexico schools, | 0016| an assessment of statewide needs relating to the provision of | 0017| career education for all students and an evaluation of career | 0018| education documenting the benefits of the program based on | 0019| established performance standards. Commencing July 1, 2001, the | 0020| department shall submit annually to the council a report | 0021| regarding the status of career education." | 0022| Section 9. EFFECTIVE DATE.--The effective date of the | 0023| provisions of this act is July 1, 1998. | 0024|  |
