0011|     RELATING TO EDUCATION; CREATING THE EDUCATIONAL RADIO

0012|     EQUIPMENT REPLACEMENT FUND; PROVIDING FOR ITS DISBURSEMENT;

0013|     MAKING AN APPROPRIATION.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  EDUCATIONAL RADIO EQUIPMENT REPLACEMENT
    |
0017|     FUND--CREATED.--The "educational radio equipment replacement
    |
0018|     fund" is created in the state treasury.  Money in the fund is
    |
0019|     appropriated to the office on information and communication
    |
0020|     management.  The office on information and communication
    |
0021|     management shall administer the fund and promulgate rules for
    |
0022|     the disbursement of the money in the fund, based on criteria
    |
0023|     developed by the New Mexico commission on public broadcasting,
    |
0024|     for the replacement of equipment at educational radio stations
    |
0025|     operated by public post-secondary educational institutions,
    |

0001|     public school districts or Indian nations, tribes or pueblos
    |
0002|     located in New Mexico.  Disbursements shall be made by warrant
    |
0003|     of the department of finance and administration upon vouchers
    |
0004|     signed by the chief information officer of the office on
    |
0005|     information and communication management.  Money in the fund
    |
0006|     shall not revert to the general fund at the end of a fiscal
    |
0007|     year. 
    |
0008|          Section 2.  APPROPRIATION.--Seventy-five thousand dollars
    |
0009|     ($75,000) is appropriated from the general fund to the
    |
0010|     educational radio equipment replacement fund for expenditure
    |
0011|     in fiscal year 1999 and subsequent fiscal years for the
    |
0012|     replacement of educational radio equipment in accordance with
    |
0013|     the provisions of Section 1 of this act.  Any unexpended or
    |
0014|     unencumbered balance remaining at the end of any fiscal year
    |
0015|     shall not revert to the general fund.
