TAYLOR | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO IMMUNIZATIONS; AMENDING CERTAIN SECTIONS OF THE | 0012| NMSA 1978 PERTAINING TO IMMUNIZATION REGULATIONS AND FUNDING; | 0013| MAKING AN APPROPRIATION. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 24-5-1 NMSA 1978 (being Laws 1959, | 0017| Chapter 329, Section 1, as amended) is amended to read: | 0018| "24-5-1. IMMUNIZATION REGULATIONS.--The [health | 0019| services] public health division of the [health and | 0020| environment] department of health shall, after consultation | 0021| with the state board of education, promulgate rules and | 0022| regulations governing the immunization against diseases deemed | 0023| to be dangerous to the public health, to be required of | 0024| children attending public, private, home or parochial schools | 0025| in the state. The immunizations required and the manner and |

0001| frequency of their administration shall conform to | 0002| [recognized standard medical practice in the state] | 0003| recommendations of the advisory committee on immunization | 0004| practices of the United States department of health and human | 0005| services and the American academy of pediatrics. The | 0006| [health services] public health division shall supervise | 0007| and secure the enforcement of the required immunization | 0008| program." | 0009| Section 2. Section 24-5-5 NMSA 1978 (being Laws 1959, | 0010| Chapter 329, Section 5, as amended) is amended to read: | 0011| "24-5-5. WHO MAY IMMUNIZE--WHO MUST PAY.--The | 0012| immunization required by Chapter 24, Article 5 NMSA 1978 may | 0013| be done by any licensed physician or by someone under his | 0014| direction. If the parents are unable to pay, the immunization | 0015| shall be provided by the [health services] public health | 0016| division of the [health and environment] department of | 0017| health. The department shall undertake every effort to | 0018| obtain federal funding to implement the department's | 0019| immunization program. No public health employee may receive | 0020| any fee for immunization service if the service is compensated | 0021| for by the [health services] public health division. | 0022| Local school boards may contribute toward the cost of | 0023| materials and supplies for immunizations." | 0024| Section 3. APPROPRIATION.--Fifty thousand dollars | 0025| ($50,000) is appropriated from the general fund to the |

0001| department of health for expenditure in fiscal year 1999 for | 0002| the purpose of hiring an ombudsman to assist local governments | 0003| and public school districts to seek additional funding for and | 0004| enforcement of laws and regulations pertaining to the | 0005| immunization of children. Any unexpended or unencumbered | 0006| balance remaining at the end of fiscal year 1999 shall revert | 0007| to the general fund. | 0008|  |
