0011|     PROPOSING AN AMENDMENT TO ARTICLE 7 OF THE CONSTITUTION OF NEW

0012|     MEXICO TO ALLOW MUNICIPALITIES TO CONDUCT RUNOFF ELECTIONS.

0014|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  It is proposed to amend Article 7, Section 5
    |
0016|     of the constitution of New Mexico to read:
    |
0017|               "|A.|  All elections shall be by ballot. ~[and]~
    |
0018|     The person who receives the highest number of votes for any
    |
0019|     office, |except as provided in Subsection B of this section,
    |
0020|     and| except in the cases of the offices of governor and
    |
0021|     lieutenant governor, shall be declared elected ~[thereto]~ |to
    |
0022|     that office|.  The joint candidates receiving the highest
    |
0023|     number of votes for the offices of governor and lieutenant
    |
0024|     governor shall be declared elected to those offices.
    |
0025|               |B.  A municipality may, by ordinance, provide for
    |

0001|     runoff elections.|"
    |
0002|          Section 2.  The amendment proposed by this resolution
    |
0003|     shall be submitted to the people for their approval or
    |
0004|     rejection at the next general election or at any special
    |
0005|     election prior to that date which may be called for that
    |
0006|     purpose.
