SANCHEZ | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| A JOINT MEMORIAL | 0011| REQUESTING THE LEGISLATIVE COUNCIL TO DIRECT THE APPROPRIATE | 0012| COMMITTEE TO STUDY THE EFFECTIVENESS OF THE RECYCLING | 0013| PROVISIONS IN THE SOLID WASTE ACT AND RECOMMEND CHANGES TO | 0014| IMPROVE THE EFFECTIVENESS OF RECYCLING PROGRAMS IN NEW MEXICO. | 0015| | 0016| WHEREAS, the legislature enacted the Solid Waste Act in | 0017| 1990 and the purposes of that act include the conservation, | 0018| recovery and recycling of resources; and | 0019| WHEREAS, landfills around the state are being closed | 0020| under the direction of the federal environmental protection | 0021| agency, and the cost of closure and construction of new | 0022| environmentally safe solid waste facilities is beyond the | 0023| fiscal capacities of many jurisdictions; and | 0024| WHEREAS, many citizens, unfortunately, find it more | 0025| desirable to dump trash in inappropriate locations and in |

0001| illegal ways, leading to a proliferation of illegal dumping | 0002| areas and litter; and | 0003| WHEREAS, many existing recycling programs are foundering | 0004| for lack of markets or lack of adequate planning; and | 0005| WHEREAS, Section 74-9-15 NMSA 1978 requires state | 0006| agencies to develop plans and implement recycling programs; | 0007| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0008| STATE OF NEW MEXICO that the legislative council be requested | 0009| to direct the appropriate committee to study the effectiveness | 0010| of the recycling provisions of the Solid Waste Act and to make | 0011| recommendations for legislation by November 1, 1998; and | 0012| BE IT FURTHER RESOLVED that copies of this memorial be | 0013| transmitted to the co-chairmen of the legislative council. | 0014|  |
