0011|     REQUESTING THE STATE ENGINEER AND THE INTERSTATE STREAM
    |
0012|     COMMISSION TO MANAGE THE RIO COSTILLA SYSTEM IN A MANNER TO
    |
0013|     ELIMINATE OVER-DIVERSION AND WASTE OF WATER.

0015|          WHEREAS, the practice and history of water appropriation
    |
0016|     and usage on the Rio Costilla system has resulted in over-
    |
0017|     diversion and waste of water resources; and 
    |
0018|          WHEREAS, as a result of the foregoing over-diversion and
    |
0019|     waste, the historic acequias have been deprived of adequate
    |
0020|     water; and
    |
0021|          WHEREAS, metering of water and other efficiency measures,
    |
0022|     if implemented and required on the system, would greatly
    |
0023|     remedy existing deficits;
    |
0024|          NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0025|     STATE OF NEW MEXICO that the state engineer and the interstate
    |

0001|     stream commission be requested and encouraged to manage the
    |
0002|     Rio Costilla system in a manner that will eliminate over-
    |
0003|     diversion and waste of water by taking at least the following
    |
0004|     actions:
    |
0005|               A.  metering water usage; 
    |
0006|               B.  ensure that all diversions are limited to legal
    |
0007|     water rights bases on a one and one-half acre foot per acre
    |
0008|     duty of water; 
    |
0009|               C.  return all unused, excess and surplus flows to
    |
0010|     the river for priority use by historic acequias with the
    |
0011|     remaining flow left in the channel;
    |
0012|               D.  prepare a water master's manual delineating
    |
0013|     daily operation of the system and delivery of water through
    |
0014|     the entire watershed; and
    |
0015|               E.  continue working cooperatively with the state
    |
0016|     of Colorado to clarify water rights questions and increase
    |
0017|     efficiency of the use of water to benefit both the river and
    |
0018|     the acequias; and
    |
0019|          BE IT FURTHER RESOLVED that a copy of this memorial be
    |
0020|     sent to the governor of New Mexico, the governor of Colorado,
    |
0021|     the state engineer and the chairman of the interstate stream
    |
0022|     commission.
