ROMERO | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| A JOINT MEMORIAL | 0011| SUPPORTING A PLANNING PROCESS TO DEVELOP REVISIONS TO THE | 0012| HOME-BASED RESIDENTIAL MODEL OF THE DEVELOPMENTAL DISABILITIES | 0013| WAIVER. | 0014| | 0015| WHEREAS, residential services provided to persons with | 0016| developmental disabilities by family members and surrogate | 0017| family members are cost effective; and | 0018| WHEREAS, clients living in the homes of residential | 0019| service providers have been shown to receive excellent, one- | 0020| on-one care in the least restrictive setting; and | 0021| WHEREAS, clients living in home environments experience | 0022| optimum behavior and quality of life; and | 0023| WHEREAS, allowing family members to provide services | 0024| helps keep families of persons with developmental disabilities | 0025| intact, and the care of surrogate family members helps create |

0001| a supportive, family-like environment; and | 0002| WHEREAS, the expansion of home-based living is one of the | 0003| recommendations of a state audit for complying with the | 0004| Jackson lawsuit; | 0005| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0006| STATE OF NEW MEXICO that home-based living services for | 0007| persons with developmental disabilities be encouraged and | 0008| supported by the department of health in its current and | 0009| future policy and rate-making decisions; and | 0010| BE IT FURTHER RESOLVED that the department of health | 0011| initiate an ongoing planning process to analyze, study, review | 0012| and develop revisions to the home-based residential model of | 0013| the developmental disabilities waiver; and | 0014| BE IT FURTHER RESOLVED that the planning process consist | 0015| of twelve participants, including representatives from the | 0016| department of health, the human services department, the New | 0017| Mexico association of family providers and provider agencies, | 0018| and that the participants be chosen by a consensus of the | 0019| department of health and the New Mexico association of family | 0020| providers; and | 0021| BE IT FURTHER RESOLVED that the results of the study and | 0022| suggestions for changes to the home-based residential model of | 0023| the developmental disabilities waiver be presented to the | 0024| interim legislative health and human services committee no | 0025| later than October 1, 1998; and |

0001| BE IT FURTHER RESOLVED that the department of health be | 0002| requested to maintain its funding to home-based providers and | 0003| maintain current regulations until the planning process has | 0004| been completed and presented to the interim legislative health | 0005| and human services committee so that home-based living | 0006| services will continue to encourage willing and qualified | 0007| family members, surrogate family members and guardians of | 0008| persons with developmental disabilities to provide services in | 0009| the home-based residential model; and | 0010| BE IT FURTHER RESOLVED that copies of this memorial be | 0011| sent to the secretary of health, the secretary of human | 0012| services, the governor and the New Mexico association of | 0013| family providers. | 0014|  |
