0001| SENATE JOINT MEMORIAL 2 | 0002| 43RD LEGISLATURE - STATE OF NEW MEXICO - FIRST SPECIAL SESSION, 1998 | 0003| INTRODUCED BY | 0004| Shannon Robinson | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| A JOINT MEMORIAL | 0011| REQUESTING THAT THE COMMISSION ON HIGHER EDUCATION RECOGNIZE | 0012| THAT ATHLETIC TUITION WAIVERS ARE AVAILABLE TO BOTH CITIZENS | 0013| OF THE UNITED STATES AND CITIZENS OF ANY FOREIGN COUNTRY. | 0014| | 0015| WHEREAS, nonresident student tuition waivers are commonly | 0016| used for nonresident students who receive resident status for | 0017| the purpose of tuition payment; and | 0018| WHEREAS, tuition waiver programs that allow nonresident | 0019| students to pay resident student rates at the state's post- | 0020| secondary educational institutions have existed in state law | 0021| since 1970; and | 0022| WHEREAS, the term "resident student" includes a student | 0023| who receives an athletic scholarship from a post-secondary | 0024| educational institution for the purpose of tuition payment and | 0025| budget and revenue calculations; and |

0001| WHEREAS, the legislature funded athletic tuition waivers | 0002| at one hundred percent in Chapter 116, Laws of 1998; and | 0003| WHEREAS, the New Mexico commission on higher education | 0004| deals with financial issues for post-secondary educational | 0005| institutions and is concerned with the financing of those | 0006| institutions and with the equitable distribution of available | 0007| funds among them; | 0008| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE | 0009| STATE OF NEW MEXICO that the commission on higher education be | 0010| requested to recognize that athletic tuition waivers are | 0011| available to both citizens of the United States and citizens | 0012| of any foreign country and that budget and revenue | 0013| calculations reflect this beginning with appropriations made | 0014| for the fiscal year 1999; and | 0015| BE IT FURTHER RESOLVED that copies of this memorial be | 0016| transmitted to the president of each post-secondary | 0017| educational institution designated in Article 12, Section 11 | 0018| of the constitution of New Mexico and to the executive | 0019| director of the New Mexico commission on higher education. | 0020|  |
