0011|     PROPOSING AN AMENDMENT TO ARTICLE 11, SECTION 2 OF THE

0012|     CONSTITUTION OF NEW MEXICO TO DEFINE THE PUBLIC REGULATION

0013|     COMMISSION'S RESPONSIBILITY FOR UTILITY REGULATION.

0015|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0016|          Section 1.  It is proposed to amend Article 11, Section 2
    |
0017|     of the constitution of New Mexico to read:
    |
0018|          "The public regulation commission shall have
    |
0019|     responsibility for <s>[chartering and regulating business
</s>    |
<s></s>0020| <s>    corporations in such manner as the legislature shall provide.

<s></s>0021| <s>    The commission shall have responsibility for]</s> regulating
    |
0022|     public utilities, including electric, natural gas and water
    |
0023|     companies <s>[transportation companies, including common and

<s></s>0024| <s>    contract carriers; transmission and pipeline companies,

<s></s>0025| <s>    including]</s> <u>and</u> telephone, telegraph and information
    |

0004|          Section 2.  The provisions of this amendment shall take
    |
0005|     effect January 1, 1999.
    |
0006|          Section 3.  The amendment proposed by this resolution
    |
0007|     shall be submitted to the people for their approval or
    |
0008|     rejection at the next general election or at any special
    |
0009|     election prior to that date which may be called for that
    |
0010|     purpose.
