AN ACT

RELATING TO HAZARDOUS MATERIALS EMERGENCY RESPONSE; REQUIRING THE DEPARTMENT OF PUBLIC SAFETY TO INCLUDE TRAINING AND EQUIPMENT IN ITS ANNUAL BUDGET REQUEST; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. DEPARTMENT OF PUBLIC SAFETY TO INCLUDE HAZARDOUS MATERIALS EMERGENCY RESPONSE COST IN BUDGET.--The secretary of public safety shall include in the annual department of public safety budget appropriation request the amount of money paid by motor carriers for hazardous materials annual and trip permits in the prior fiscal year. The money shall be specified for hazardous materials emergency response training and equipment.

Section 2. APPROPRIATION.--One million three hundred thousand dollars ($1,300,000) is appropriated from the general fund to the technical and emergency support division of the department of public safety for expenditure in fiscal years 1999 through 2001 to provide hazardous materials emergency response training and to purchase equipment for hazardous materials emergency response. Any unexpended or unencumbered balance remaining at the end of fiscal year 2001 shall revert to the general fund.
