AN ACT

RELATING TO PUBLIC EMPLOYEE SALARIES; INCREASING CERTAIN SALARY LEVELS; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATIONS--GENERAL FUND.--

A. Eighty-seven million nine hundred fifty-seven thousand two hundred dollars ($87,957,200) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2000 to provide salary increases to certain public employees as follows:

(1) twenty-seven million three hundred forty-three thousand one hundred dollars ($27,343,100) to be distributed through the state equalization guarantee distribution of the public school fund to provide an average three and one-half percent salary increase for teachers, and sixteen million six hundred sixty-three thousand nine hundred dollars ($16,663,900) to provide an average three and one-half percent salary increase for other certified and non-certified public school employees, including transportation employees;

(2) fifteen million eight hundred twenty-one thousand eight hundred dollars ($15,821,800) to be distributed by the commission on higher education to provide an average three and one-half percent increase for all state employees in post-secondary educational institutions and in vocational schools under their respective jurisdiction;

(3) twenty million nine hundred forty-three thousand four hundred dollars ($20,943,400) to provide a four percent salary structure adjustment to be applied to the personnel board classified salary schedule and given to all incumbents governed by the Personnel Act, except those whose salary is higher than the maximum of their assigned salary grade, effective the first full pay period after July 1, 1999, and to provide a three and one-half percent of mid-point performance pay increase to eligible classified employees who meet or exceed performance criteria in accordance with a performance pay plan developed by the state personnel office effective the first full pay period following an employee's anniversary date. Incumbents whose salary is higher than the maximum of the fiscal year 1999 assigned salary grade, but equal or lower than the new values of the salary grade shall receive a salary structure adjustment sufficient to place them at the highest value of their assigned grade on the adjusted salary schedule, and will be eligible for a lump-sum performance-based salary increase;

(4) one million four hundred twenty-eight thousand five hundred dollars ($1,428,500) to provide a five percent salary increase to all exempt executive employees, except teachers in the children, youth and families department, the department of health and the corrections department and employees under the state police plan, effective the first full pay period after July 1, 1999;

(5) three hundred thirty-one thousand eight hundred dollars ($331,800) to provide exempt teachers in the children, youth and families department, the department of health and the corrections department a five percent salary increase effective the first full pay period after July 1, 1999;

(6) three hundred fourteen thousand one hundred dollars ($314,100) to provide eligible commissioned officers of the New Mexico state police division of the department of public safety a step increase from approximately two and two-tenths percent to three percent in accordance with the career pay system for the state police;

(7) two million four hundred forty-nine thousand five hundred one dollars ($2,449,501) to provide a four percent salary structure adjustment to be applied to the New Mexico judicial branch salary table and given to judicial employees, other than employees, other than employees whose salaries are set by statute, effective the first full pay period after July 1, 1999 and to provide a three and one-half percent of mid-point performance pay increase to eligible judicial employees effective the first full pay period following an employee's anniversary date in accordance with a performance pay plan developed by the administrative office of the courts;

(8) five hundred twenty thousand dollars ($520,000) to a provide four percent salary increase for judges, child support hearing officers and special commissioners effective the first full pay period after July 1, 1999;

(9) for district attorney employees, one million seven hundred fifty-three thousand nine hundred fifty-nine dollars ($1,753,959) to provide a four percent salary structure adjustment to be applied to the district attorney salary schedule and given to district attorney employees effective the first full pay period after July 1, 1999, and to provide a three and one-half percent of mid-point performance pay increase to eligible district attorney employees effective the first full pay period following an employee's anniversary date in accordance with a performance pay plan developed by the administrative office of district attorneys;

(10) forty-nine thousand six hundred dollars ($49,600) to provide a four percent salary increase to district attorneys effective the first full pay period after July 1, 1999; and

(11) three hundred thirty-seven thousand five hundred dollars ($337,500) to provide permanent legislative employees, including permanent employees of the legislative council service, legislative finance committee, legislative education study committee, legislative maintenance department and the house and senate, with a five percent salary structure adjustment effective the first full pay period after July 1, 1999.

B. The department of finance and administration shall distribute a sufficient amount of funds to each agency to provide the appropriate increases for those employees whose salaries are received as a result of the general fund appropriations in the General Appropriation Act of 1999. Any unexpended or unencumbered balance remaining at the end of fiscal year 2000 shall revert to the general fund.

C. For those state employees whose salaries are referenced in or received as a result of non-general fund appropriations in the General Appropriation Act of 1999, the department of finance and administration shall transfer from the appropriate fund to the appropriate agency the amount required for the salary increases equivalent to those provided for in this section, and such amounts are appropriated for expenditure in fiscal year 2000. Any unexpended or unencumbered balance remaining at the end of fiscal year 2000 shall revert to the appropriate fund.
