AN ACT

RELATING TO PUBLIC FINANCES; PROVIDING FOR PAYMENTS TO THE STATE BY ELECTRONIC TRANSFER AND CREDIT CARD; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. PAYMENT METHODS AUTHORIZED--APPROPRIATION.--

A. A state agency may accept payment by electronic or optical means of any amount due the state under any law or program administered by the agency.

B. A state agency may accept payment by credit card of any amount due the agency under any law or program administered by the agency. If the agency must pay a charge to accept payment by credit card, the amount of the charge shall be added to the amount due from the person making payment by credit card. The amount of the charge to the taxpayer is appropriated to the agency for payment to the credit card company.

Section 2. REPEAL.--Section 9-11-6.3 NMSA 1978 (being Laws 1995, Chapter 31, Section 4) is repealed.
