AN ACT

RELATING TO HEALTH; AUTHORIZING THE HUMAN SERVICES DEPARTMENT TO PROVIDE PERSONAL CARE SERVICES UNDER THE MEDICAID PROGRAM; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. MEDICAID PERSONAL CARE OPTION--AUTHORIZATION.--Subject to the availability of state funds, the human services department may provide personal care services to persons under the medicaid program, in the amounts consistent with federal law to enable the state to be eligible for medicaid funding. Individuals shall be determined to be in need of personal care services according to rules of the department.

Section 2. APPROPRIATION.--Two million eight hundred thousand dollars ($2,800,000) is appropriated from the general fund to the human services department for expenditure in fiscal year 2000 to provide or contract for personal care services under medicaid. Any unexpended or unencumbered balance remaining at the end of fiscal year 2000 shall revert to the general fund.
